It can't get any more clear than this case. 14 whites and one latino pass the test, which is based purely on how knowledgeable you are at fighting fires, for promotion. But no blacks pass the test (study more maybe?). So the city throws out the test, fearful of the R card and the deserving candidates who met all criteria get nothing. This would be a great start to eliminate AA once and for all.

Now given the pass ratio of all people who take it obviously it is a very tough test. This is a very important case, let's hope the court brings justice to the victims.

"In fact, as the white firefighters' lawyers pointed out, federal law says that an employer may not "alter the results of ... employment-related tests on the basis of race" after the fact."
