Disabled Person Parking Placard Question

A situation today made me think of the the following questions:

Let's say you have a spouse/parent/roommate who is disabled (let's call him/her DP), DP has a Disabled Person Parking Placard and you two share a car. Then, let's say that you and DP both take BART (Bay Area subway or you can pick any subway with parking) to work. Then let's assume that your schedules are such that, on some days, one of you drives the car and drops off the other at the BART station a few hours before the other has to go to work, then the driver returns later to park the car at the station. In addition, one of you (the non-driver that morning) returns to the BART station before the other, takes the car and returns later to pick up the other person (and there is no convenient bus line near your house).

Here are the questions:

1. When DP drops you off first (meaning you will return to the station before DP at the end of the day), can DP park the car in the handicapped spot?

2. When you drop DP off first (meaning DP will return to the station before you at the end of the day), can you park the car in the handicapped spot?

I think the answer to No. 1 is more likely to be yes than No. 2, but I just don't know. Nothing I have found online gives a clear answer.

You're a lawyer and you're asking a question about the law on Anandtech. :laugh:

I agree with your assessment, but morally/ethically I don't think there is a problem with either.

LOL. I do my research here, on Wikipedia and using Google. Westlaw and Lexis suck ;)

I agree with your assessment, but morally/ethically I don't think there is a problem with either.

Yeah, I think either way DP is getting use of the handicapped space, as he should. Obviously, however, you are also getting some benefit, too. If it was me, I would just park it there both ways and walk with a limp ;)

Yes and yes. If you get a ticket you can have the person with the DP send in proof or what have you.

The only problem I see with this is that the DP is supposed to carry the paperwork from DMV to prove that they are legally entitled to the placard, (sort of like the temporary license you get when you apply for a drivers license) and should a cop question your use of the placard, you'd have no way to prove that you are entitled to use the placard. Legally, you are supposed to have the DP with you when you use the placard, not just park the vehicle there for them when they get off work.

I'm sure if you got such a ticket, (IIRC, $270 fine) a judge might understand and throw it out, but even that's a crapshoot.

I have one of these placards, and my wife does NOT use it unless I'm physically with her in the vehicle.
