1. Senate voting against appointments (fat chance before January at minimum)

If it is a peaceful election, without violence and attacks from trumpanzee's on polling places, poll workers, boards of elections. We've already seen protests to intimidate voters at early voting in VA.

I fully expect nationwide civil unrest in early November, just not sure if it will be before, during, or after election day, instigated by trumps rhetoric. If the numbers are really bad for Trump, and I can't see why they wouldn't be, the hardcore supporters are going to loose their shit and act out accordingly.

He is a ruthless and desperate man, and there are really no limits on what he will do to retain power.

If they wanted an easier time to pack the court, Pelosi should be uses the arrows in her quiver, yet it looks like she lied about it. They have several options to force the confirmation from happening before the election, but the Democrats have made a choice not to use them. Forcing Republicans at least to get a confirmation only in the lame duck would make them look bad if Biden wins as big as the polls indicate now, and it prevents Amy and the other conservative justices from scoring "independence" points if Trump forces a stupid controversy to the SC on whether to throw out the mail-in ballots.
