And that was exactly the OP's point - this was an exclusive carried by Dicks, sold Exclusively by Dicks, manufactured exclusively for Dicks. The OP couldn't go anywhere else, and the store refused to fulfill a transaction that has already had been committed to contractually.

Bullshit, it's quite clear Dicks broke state laws. They were clearly legally in the wrong here. You can't just not deliver what you contracted to deliver and had the ability to deliver the goods. Have you ever read purchase order or sales agreement?

Yes, I've read, and helped written, many purchase and sales order agreements. Have you? As displayed in many of your posts, you clearly don't do much reading vs. just posting from the piehole. And the contract you're referring to also states that the business can, at any time before delivering a product, cancel a sale for any reason and the customer would be made whole. The customer was more than made whole in this transaction...unfortunately for the business and other consumers, the rotten fruit gets immediate attention and they paid him to go away.

I reiterate, if this fuckwad was doing this for principle, he'd take to court and make the company admit guilt. He didn't. He got what he wanted which was crybaby money and he's quietly walking away trying to look like some internet martyr.

He wasn't "made whole" in anyway shape or form. He was unable to get a comparable product for the money Dick's refunded.

You are aware that there are more lawsuits over this, right? State laws were clearly broken. You simply cannot deliver a product you are capable to deliver and agreed to deliver by contract.

I'm having a difficult time what's so hard to understand. This is very cut and dry, state laws were broken and the buyer has legal recourse he can seek.

So OP paid for an item, waited four weeks for delivery of said item and never received it.


Who cares what the item is.

Let's say the OP purchased a car. It has been paid for a tendered, just waiting for it to arrive in a month. It finally arrives, but suddenly the car market goes crazy and the car is worth 10k more. The car dealership decides not to sell him the car and instead refund his money plus $100 so that they can sell the car at a higher price now.

Is this ok?

Obviously, no. The reason for them refunding the order when they have the product is really of no importance. The fact is they refuse to give him an item that he has already purchased and they have. I don't blame the OP for fighting big business. Big business screws us every chance we get, when one of us stands up and fights them we are going to hate on them? Seems very stupid to me.
