defective gas pump == gas all over my car

Does the auto manufacturer take responsibility for mechanical failures caused by normal wear and tear?

How do you know this gas pump failed due to normal wear and tear?

How do you YOU know it failed due to a manufacturing defect? The problem does not seem to be systemic in any way. Millions of people operate a fuel pump every day and this problem seems to be relatively infrequent. There's no evidence in this thread to lead one to assume that issue was caused by anything other than either normal wear or user error.

Gas cap stuck under the handle takes care of that - provides the same function (and it still shuts off automatically.)

To the OP, you must be pretty new to filling the gas tank - you didn't even notice the higher pitched sound as it became closer to full??

Yes they fscking ARE resonsible. If it did have a chance of messing up my paint they would be for it to be fixed. They own the pumps, they are responsible if one breaks. Sorry bud.
Quit worrying so much about your precious paint and take a little responsibility. Equipment breaks and you are responsible for protecting your own property, not them. You shouldn't be so naive to expect the gas pump to work 100% of the time, and should have been on the watch for a problem.

It's your car. If you trust it's safekeeping to people you don't know then I would say you are the idiot. You have every right to be ticked off that it happened, but you could have prevented it had you been paying attention. And yes, I am telling you that you can't expect anything to work 100% of the time. Mechanical failure is a fact of life.

Since this is a tech board let me ask you this. What do you do if your harddrive crashes and you lose all your data. Is it the manufacturers fault? No. They are not responsible for protecting your data and losing it is the risk you run. A wise person would protect their data with some kind of backup. Everybody else would simply bitch about it on ATOT.

Technically if your HD crashes and you lose your data within the warrenty it could be taken as being the manufacturers fault, though maybe not legally.

Personally I've had 2 Hard drives fail on me in the last year within 6 months of buying them, and I was pissed off.

Again, technically, since the hard drive manufacturer puts a year or 2 guaruntee or the hard drive, they actually directly or indirectly promise that the hard drive will do its job (store data) for the 1 or 2 years - so they may be able to be held responsible.

You're comparing a failing gas pump to a failing hard drive.

If the gas pump fails, it spews gas all over the place. if your HD fails, your data is lost. Big difference.

At least use a comparable analogy that makes sense!

They send you a replacement hard drive. They do not pay for the extraction of any lost data. Gas station should have knocked a couple of bucks off, at most gave a complimentary fill-up next time
 
So much niavete. You cannot sue a HD manufactuer for lost data. Along the same lines, you cannot sue a development lab for ruining your photos. Why? Read the terms of use. If your HD dies, they send oyu a new drive. You bitch about your data, they laugh at you. It's YOUR resposibility. If you take vacation photos to a lab and they lose them, they only owe you a roll of unexposed film. Same thing. The most they would ever do is pay for the amount of gas spilled, which is less than 50 cents. Whoop de fscking do. It's your responsibilty to operate the pump. You are trying to compare a pump that stops filling based up a single mechanical principle to a car crash that kills enough people to merit a recall. Christ, if you can't see the difference....

But no, they are not going to do anything for you. Sorry. Been there, done that, you aren't the first person this happened to and won't be the last. Plus I have a hard time seenig how you let a HALF GALLON OF GAS spill before you realized the pump shutoff wasn't working. That's 20 seconds of gas spilling out. WTF were you doing?

You asshats are probably the same people as those that are suing McDs for their fat ass. Where is the personal responsibilty anymore?
