Death penalty recommended in Iraq raid By ALICIA A. CALDWELL, Associated Press Writer, 12 minutes ago, sat, sept 2, 2006.

An Army investigator has recommended that four soldiers accused of murder in a raid in Iraq should face the death penalty, according to a report obtained Saturday by The Associated Press.

Lt. Col. James P. Daniel Jr. concluded that the slayings were premeditated and warranted the death sentence based on evidence he heard at an August hearing. The case will now be forwarded to Army officials, who will decide whether Daniel's recommendation should be followed.

The soldiers, all from the Fort Campbell, Ky.-based 101st Airborne Division's 187th Infantry Regiment, are accused of killing three Iraqi men taken from a house May 9 on a marshy island outside Samarra, about 60 miles north of Baghdad.

Staff Sgt. Raymond L. Girouard, Spc. William B. Hunsaker, Pfc. Corey R. Clagett and Spc. Juston R. Graber have claimed they were ordered to "kill all military age males" during the raid on the island. According to statements from some of the soldiers, they were told the target was an al-Qaida training camp.

Hunsaker told investigators that he and Clagett were attacked by the three men, who were being handcuffed, and shot them in self-defense. Clagett said he was hit in the face, and Hunsaker claimed he was stabbed during the attack.

Prosecutors argue the soldiers conspired to kill the men and then altered the scene to fit their story. They contend Girouard stabbed Hunsaker as part of the killing plot.

Clagett, Girouard and Hunsaker also are accused of threatening to kill another soldier who witnessed the slayings. Girouard, the most senior soldier charged, faces several additional charges, including sexual harassment and carrying a personal weapon on duty.

Paul Bergrin, Clagett's civilian attorney, said he was surprised that Daniel recommended the case be taken to trial at all.

"I'm extremely disappointed and disheartened," Bergrin said Saturday. "They are being used as pawns in the war on terror. They followed the rules of engagement. They were confronted with violence by a known al-Qaida training camp member."

Other lawyers in the case, several of whom are deployed to Iraq, did not immediately respond to e-mail requests for comment.

The soldiers are expected to be tried at Fort Campbell. They have been jailed in Kuwait since their arrests this year.

The U.S. military has not executed a soldier since the 1960 hanging of a soldier convicted rape and attempted murder.

I have no issues with the death penaltie recommendations!
I agree if it was premeditated it should be addressd in that way!
But if something like that happens in the course of a military manuver or as some would say civilian casualties; then its obvious the 2 are seperate and distinct cause and effects.
Sure there were deaths on both sides. That can`t be disputed.
But there is a huge difference between planning and carrying out civilian deaths verses death via a military operation!!

My attitude towards all the USA Military raping, torture and murder going on, (there's a lot of it folks) has changed during the course of learning that the leadership of these soldiers is 90% to blame for every bit of it.

Get this. The leadership from pResident Cheney on down, through the Neocon ranks within the Executive Branch, through their Neoconned Generals at the Pentagon, to the Perfumed Princes strutting around in General uniforms in Iraq/Afghanistan, all can suck the chrome off a trailor hitch.

Under those total bizzare circumstances, combined with the harsh abuse put on our troops such as forced slavery by way of extended tours and multiple tours in hot urban hellhole combat, i believe in total withdrawel of all USA Forces and deprogramming of every soldier. Total amnesty for war crimes would be conditional upon successful deprogramming.

Our Nation's leadership is non leadership. They are manipulators of men as if they were pawns. Game over. Bring all our men home. Let's sort out the mess here and get ready for WWIII. With real leadership. Globalist Whores need not apply.
 
Like the guy on Colbert Report interview said, the marines did all the could in military terms. The goal was achieved, now do you expect 20 year old soldiers who are trained for combat/to kill be the peace keepers?

Your rant is absurd. A pre-meditated murder cannot be blamed on anyone but the perpetrator. When your family is cut up and eaten by a serial killer, would you blame the system, his parents and his little league coach? I think that you would want prison at the least for life for the subject.

I get it....you hate Bush so much that you are willing to forgive pre-meditated murder of innocent civilians to prove your point. You sir are no better than those soldiers if this be the case. If not, please explain yourself without ranting.

Anyway, it could be taken that way as your comment avoids the distinction between (and I hate the way this sounds) 'legal killings,' and wanton murder. Would you find 'do not kill illegally, or we will kill you legally" equally absurd?

What I find absurd is that people push killing as a penalty for killing. It is absurd to do to somebody what you tell them not to if they do.
