Burbank ca frys has tried to sell me used OEMS with thermal paste still on them, im starting to think this is the worst of all the frys stores in california.
 
yes i got it last night and it is retail box too. it had a packed oct 28 sticker from intel on it too. im sure it is the latest stepping but it it actually printed on the chip itself?

If you see "SLB8V" on the chip (that's the S-spec), then it's the latest core stepping (E0). That's your proof. But "E0" is not on the chip itself.
