Ok, first off:

- Yes these people are idiots and scum
- Yes they should be in jail

BUT......

I don't see how talking to someone who isn't really 13....(they use decoys who are of age) and never actually did anything wrong other than show up a house they were lied to about......

If I get on the internet, talk about wanting to drink and drive over .08, and then goto a Bar.....I can't be arrested for drinking and driving.....I actually have to drink and drive over .08

The cops say "We prevented a crime". What? What actual crime did you prevent? How can the cops know that if they weren't in that chat room soliciting people to come to their house for sex, that these people would be going to someone elses house?

Unless I'm mistaken the decoys can't be the first ones to bring up sex. So its always the person on the other side who brings it up, the decoy just goes along with it. I think the act of showing up the house is enough to be considered intent to commit the act, and that's the illegal bit (not sure if that's enough to get them arrested in every state, but it is in some at least).

I guess because of the severity of the (potential) sexual act, it justifies the severity of the punishment for intending on committing the act.

But still you can't help but feel a bit sorry for some of them, their life after this is now completely ruined (not like they didn't deserve it). What a waste of someone's life

people like this just don't wake up one day and decide "you know what?...I think I'll try ans score some tang off a thirteen year old girl".

They start small simply looking at pictures or movies (which is illegal by the way) and it escalates....if this was their first time they fucked up and deserve to go to jail just for being so godamned stupid but I would be willing to bet that for many, this is just the first time the were caught.....fuck 'em.

that is like saying you can't be arrested for plotting to murder someone because you never actually went through with it.

The law says it doesn't matter who is on the other end, if you believe it was an underage person, it is illegal.

I'm not saying its right what they did, just think it's a slippery slope when we bust people who technically haven't done anything illegal......except want to have sex with a 13 year old that doesn't exist on the other end.

If he really solicited a real 13 year old, and really went to the 13 year olds house, BAM crime committed.

In fact, I believe I read that judge in one of these cases kicked all the arrests because the person on the other end wasn't a real child...which essentially made it not a crime.....

While I see your point, this type of prevention is necessary for crimes which are so difficult to stop in the act. Drunk driving is easy to stop in progress because the police can patrol the roads and look for erratic drivers. Child predation is not like this because there is no public area for it to be readily seen in. The two people, adult and child, make their arrangements in private and typically meet in private. So enough decoys have to be placed in the area where predators find children, the internet, so there is enough fear of that area to deter criminals.

Doesn't matter if there's no child. The other person had the PERCEPTION of a child.

In many laws, it only matters if ONE person has a perception that an illegal act occurred, or will occur.

I dare ya to go up to someone on the street (random person) and say "i'm gonna blow up a building"

now... you don't have any explosives, and that person happens to be a cop.

Well.. you're under arrest for attempted destruction of public property.

Doesn't matter that you didn't do it...

The perception that you wanted to exists.

while i agree these pervs should be in jail. I do have a lot of issues with the "sting" operations. Unless they change a lot of thngs. in the orginal ones there was not any cops watching teh "children" so there was nothing to stop the people from makeing shit up and not doing it by law.

You "don't see" from a moral perspective or a legal perspective?

From a moral perspective - if you believe you're doing something, is that not just as bad as actually doing it? Those guys who tried to blow up a synagogue with fake explosives (that they believed were real) - was that not just as bad as if they had been given real explosives?

From a legal perspective - I don't know what laws these guys are breaking, but if none of them broke any laws, none of them would be successfully prosecuted. Some have not been successfully prosecuted, but some have been.

The other side of this argument is if cops were to set up sting operations offering people $1 million stolen from a bank. Let's say you do 10,000 sting operations all across the country, a huge campaign against bank fraud. You probably catch at least a few hundred people, and punish them as if they had committed bank fraud of this magnitude. Now are these few hundred people really threats to the public, did you really just happen to stumble upon a few hundred people who were about to commit bank fraud? Or did you just create an opportunity for them, create a crime out of thin air?

This sort of example should be in the minds of law enforcement as they pursue child predators. They should make sure their operations catch those who are actively seeking children, rather than presenting opportunities to those who otherwise may not have committed a crime.

I believe a judge actually dropped the charges against all of them in one of the counties because it was not real and over the Internet.

the crimes they are charged with is solicitation of a minor and nothing more.

you are right, they didn't actually do anythihng with the minor, so tey aren't charged with having sex with a minor.

it's strictly solicitation of a minor, and the first episode of it actually didn't involve anyone getting arrested at all. the police officers run their investigation completely seperate from dateline.

i've seen all of them and they are great, and i've seen specials on them as well.

I think you're referring to the prosecutor in Texas that declined to prosecute anyone caught in the sting, because the investigation was led by civilians and he didn't think he could get convictions. It wasn't because no one had committed any crimes or because it happened over the Internet.
