hi. i'm a little depressed. i'm about to be canned from work for disciplinary reasons.

i read that i may still be eligible for unemployment insurance (benefits) despite the disciplinary
problems if the offence was not severe. is this true ?

i was a security officer at a museum in nyc and was caught, more than once, reading on post. no
drugs, fighting, cursing, yelling. i was very quiet, kept to myself, just suffered from tremendous
and unrelenting boredom which i tried to alleviate by reading at select times throughout the day.

yes, jobs sucks, but i don't know what to do with myself. i was there for 43 months. a few bad
turns at critical development points in my life has left me a tad aimless and unprepared for the
big bad world.

does anybody have any experience with unemployment insurance, esp. in the state of new york ?

also, does anyone know how unemployment insurance is paid ? by employers specifically ? can
they contest theclaim and is there approval required ?

You should look at this as an opportunity to do something better with your life. Find a job that you will enjoy more.

Yes it is still possible to collect. Yes the employer can (and will) contest the claim at a hearing where you, a member of the unemployment office and a representative from your former work will be present.

Down here in Lousiana, you only collect benefits if you are out of work due to NO FAULT of your own (laid off, cut back, jobs move oversea, etc.). Since you are about to be canned due to discipline reasons (caught more than once), that will be touch.

Just go ahead and apply anyway, and try to fight it. The worse they can do is no.

Just learn your lesson and move on, maybe you will find something better. Good luck.

that sucks. thanks though.

according to the link provided by dantworth (thank you) ny state law appears severe
regarding the disciplinary issue, at least as stated there.

it says simply that you're disqualified from receiving 'because of misconduct.' doesn't
elaborate expect in cases of criminal misconduct, which don't apply to me.

i was a union employee and i was thinking about contesting the dismissal on grounds
management violated fair hearing practices. i was marked down with violations that
were never brought to a fair hearing. in essence, i was condemned by one manager's
obervations of alleged misconduct that he treated as presumptive guilt.

whats the latin terms for this :) ?

i will probably apply. i think i may pursue a dual track appeal. the unemployment people
may be taken aback to learn a major museum employer is using questionable - underhanded ? - tactics to circumvent fair hearing practices.

and my union office appeal (i.e. the grievance) through the various levels and channels will also emphasize the same. i will not mention my particular disciplinary infractions, and
try instead to shift the focus onto their methodology. quibbling over how severe what i did may be pointless and too predictable -- an easy win for them. but their methods . . . that
transcends poor little me and brings their practices into accounting.

One more thing, I think it is a little bit odd that they would canned you from reading while on duty. Unless you are reading in full view of the public (BIG TIME NO NO).

I know this because I work for a very large company and the security guards read stuffs all the time, but not in full view of the public. Unless there is something else and you don't want to tell us about it.
