They aren't able to write for themselves, though Leno has already violated this and they likely will too. I don't see why Leno puts up with it, the union is supposed to be representing all writers but instead it is giving Letterman an unfair advantage.

The union isn't giving Letterman an unfair advantage, Letterman is giving himself that advantage. He owns his own show so he could negotiate a deal on his own with his own writers. NBC owns the Tonight Show and won't negotiate on those same terms.

I look forward to see how Stewart and Colbert do. I think they both have good improve skills so I think they'll be OK. They may intentionally not want to be "as" good since they'd like to see the writers come back.
