Crossing over double solid yellow lines

My wife was in an accident on Saturday where a driver was making a left hand turn and smacked into her car.

The other driver wrote in the accident report that she "did not realize there was someone in the other lane" when she pulled out into traffic and hit my wife.

If you copy and paste these coordinates into google maps you will come to the corner where her vehicle came to a stop

40.93113N 73.05295W

Now, if you go back and look the driver was attempting to make a left out of the 7-11 parking lot across those 2 solid yellow lines. Is that legal?

Side note: just got the estimate back from the insurance company and looks like she did $12,000 worth of damage to our car :(

Well when you are driving it's not legal, but if you are pulling out of a parking lot it is. Otherwise how would you go left?

Need pictures but if she's turning into the street, should be legal I think. If she's traveling on the street and crossed the double yellow lines, then that's not allowed (again IANAL)

You are "driving" pulling out of a parking lot. You cannot legally cross those double yellow lines, which means there is too much traffic on that (obviously) multi-lane road to try that manuever.

Edit: Apparently it varies from state to state.

If there are no 'No left turn' signs, I'm going to say it was a legal turn coupled with a(n) (illegal) failure to yield.

Edit: Are we talking about Patchogue Road or the other one?

Agree its legal but that doesn't mean the person making the left isnt at fault

Well, she was on route 112 (Patchogue Road) traveling southbound. She was in the left lane and the person pulled out of 7-11 and made the left.

According tot he Federal Highway Administration, the double yellow is to be used exclusively to mark the center line on US Highways (i.e., no single yellow). The street in question is Highway 112. The lines represent a highway center line only and do not really carry any additional weight or meaning.

Yeah you can make a left out of that parking lot, you just have to be careful and watch for traffic (something the other woman clearly didn't do).

You can cross a double yellow line when turning into or out of a driveway or private road or if making a legal U-turn.

In either case, just like in any other turn, it is the driver's responsibility to properly yield and turn only when deemed safe.

Dude, you're too vague in your initial post. Give us street name and directions that each vehicle were traveling. It sounds like someone rear-ended your wife. Is that correct? Most times the person doing the rear-ending is at fault.

I thought you could cross double yellow lines when entering or exiting a parking lot or driveway. But I guess it varies by state.

making a left across a two lane road is rather stupid, IMO, but i don't think it's illegal in this case. IANAL

here in az she would be at fault just because she was making a left turn. she failed to yield to oncoming traffic, regardless whatt the lines say. and as far as i know, the double yellow means no passing for either direction. unless posted with "no left turn" signs, she had the ability to make a legal left turn. too bad she didnt complete a legal left turn, as part of that is making sure there is no traffic coming.

Hope your wife wasn't injured or anything. So your wife was on patchouge road going south (i.e. coming from the left if you are in the parking lot facing patchogue) and they just didn't look to the left before turning left into the road (i.e. heading N on patchogue)?

how is that stupid??? there are plenty of stores here in Dallas where you need to cross 3 lanes of traffic to go left out of the parking lot...not sure why you think it would be any 'stupider' to cross 2 lanes...

you have never left a parking lot to make a left turn across more than 1 lane of traffic?
