as for the OP, id probably not have cared, but i do understand that some people are squeamish and cant handle death in public. the manager could have handled it differently, but not really that big a deal. the bereaved will probably never go to that applebees again, but whatever.

It's a shitty restaurant anyway...they aren't missing much. It's no P.F. Changs that's for sure. ;)

I don't see those laws giving anyone the right to transport them in a car.

As others have mentioned, an activity is considered legal unless it's considered specifically through law to be illegal.

These people broke no laws, and frankly live humans are much more dangerous to your health than cremains.

You know you have molecules of dead people's pee in your body right?

The OP was asking for opinions. It doesn't seem like he was just being nasty and it would appear to me he was trying to sort through if he was right or not. People make mistakes in judgement and I get the sense he was trying to make sense of this all. No excuse for you jump on his wife like this. This post is way over the line.

That booklet just covers the disposal of cremated remains and they have 12 pages devoted to the scattering or disposing of cremated remains, where you can dispose of them, how you can dispose of them, what forms you must file etc. Do you really think if that much thought was devoted to disposing of simple ashes that it would be appropriate to take them into a restaurant?

§ 103055. (a) If the certificate of death is properly executed and complete, the local registrar of births and deaths shall issue a permit for disposition, that in all cases, shall specify any one of the following:
(1)
The name of the cemetery where the remains shall be interred.
(2)
Burial at sea as provided in Section 7117.
(3)
The address or description of the place where remains shall be buried or scattered.
(4)
The address of the location where the cremated remains will be kept, as provided in Section 7054.6, under the conditions the state registrar may approve, including, but not limited to, conditions in keeping with public sensibilities, applicable laws, and reasonable assurances that the disposition will be carried out in accordance with the prescribed conditions and will not constitute a private or public nuisance.

(b)
Notwithstanding any other provisions of this part relative to issuance of a permit for disposition, whenever the death occurred from a disease declared by the state department to be infectious, contagious, or communicable and dangerous to the public health, no permit for the disposition of the body shall be issued by the local registrar, except under those conditions as may be prescribed by the state department and local health officers.

Hmm, "conditions in keeping with public sensibilities." I wonder if this scenario might fall under that statement. I suspect it would.

Regardless, it obviously offended the sensibilities of the OP and the restaurant manager agreed so out the door they went. I have no problem with what the OP did or what the restaurant manager did.

That's saying that you can't do something like put Hitler's ashes in a known Jewish neighborhood where it would be a public nuisance or hang Osama bin Laden's ashes over the former site of the World Trade Center.

There is lack of context at least to certain extend - wich is prob not known but is worth to think about - if it was for them single act to commomorate thiers mother or regular visits - personaly i would be ok with both but i can see peoples being not ok - thou if they wanted to have last diner with thier mom in her favourite place - wich would make sence discusing alot about her - than i def would be fine with that and even if i wouldnt - for that one time i would totaly give them peace - if it would be regular occurace than it would be difrent discussion

OP deserved a quick backhand frankly .... they're ASHES not a "body" and any health-code violation was purely technical.

Having said that I don't think I would carry my moms ashes around with me at all! :oops:

-My brother in law passed recently and we decided to scatter his ashes here around his hometown.

Let me tell ya carrying ashes on an airplane might be weird but sending them via USPS is absolutely weirder.

Nothing like picking up a box of your BIL's remains at the post office with large HUMAN REMAINS plastered along the side, and then get home and drop off your BIL's remains on the dining table like he were any sort of Amazon chachki to be opened later... definitely pretty damn weird.

Reminds me of one of my former deleted neighbors, visiting a local restaraunt that I was at, and the couple that adopted her baby she had (she's deleted, remember, so she's not allowed to have kids), was CHANGING THE BABY AT THE TABLE. WTF.
