Credit Card Problem..... what to do ?

Alright... so I have this credit card. I have had it since like June of 01. NO Late payments up until June of '02.

In June, I go to their webpage to make a payment. There are three options. Pay Now, Pay on Due Date, or Pay on Specified date. I setup my June payment to pay on the Due Date, which was June 30th. June 30th was a Sunday. They didn't charge me until July 1st, thus making my payment late. They charged me a late fee. I called when I got my statement and bitched. They said tuff sh1t. I *was* going to just pay it and let it go.

Until July's payment was messed up. I set it up to pay on like July 23rd or something so that I wouldn't have to worry about their system screwing things up. I went through all the steps, clicked submit. I did not print off the confirmation page. Apparently I should have. For some reason, it never went through. After making the payment, I didn't give it a second thought, so I didn't find out that it didn't go through until I got my statement on around August 12th.

I called and complained. Talked to some guy. He said he would refund the late fee for July. I asked him about June. Told him the story. He said he would refund that as well, and didn't understand why the original person I called didn't refund it.

About 8 days went by, and I didn't show anything regarding the refund on my account so I called them. The lady I talked to said she didn't show anything. I explained to her what happened. She said she would refund both late fees. I was assured they were in the system and they would show up on my next statement.

Today I got my statement. It doesn't show any refunds. So, I call them up. Explain to the first CSR the entire mess. He says he can refund one of them, but not both. I tell him that is not acceptable and ask to speak to his supervisor. He transfers me. He tells me the same thing. He goes on to say he doesn't show I called in *ever*. I tell him he pretty much has two choice. He can refund both late fees and keep me as a customer. Or he can not refund them, and lose me as a customer forever. On top of that, I WILL not be paying the late fees. He chooses the latter and closes my account. At this point, I am pissed off and just hang up.

I calmed down and called back. Asked the first guy I got what he shows as the last time I called in. He says earlier today regarding some late fees. I then ask him what about before that. He says August 20th. That happens to be the date from the second call I made. He says what can I help you with. I said I would like to resovle this issue with the late fees. He transfers me to his supervisor. I argue with her for about 10 minutes, she won't budge. I ask for her supervisor. I talk to him for about 10 minutes, he won't bugde either. He says he can't refund it. I ask for someone who can. He then changes his mind and says he can, but that he is "denying my request". At this point, I got pissed off. I turned it around and say "Well then I am denying your request for me to pay either late fee" He didn't like that. I tell him he can refund both or they have lost me as a customer forever. He says my account is already closed. I say something to the effect of good, leave it that way. You guys are a fvcking joke. He says Thank you sir, have a nice day. I hang up.



Any suggestions on what I should do? Its not the money. At this point its a matter of principle. Their website screwed up two payments and now they want 50 dollars in late fees because of it. Thats a crock of sh1t.

Well, you don't have much leverage. Your account is already closed. You were only a customer for a little over a year. Did you pay a lot of interest, or did you pay in full every month? If you paid in full, did you charge a couple thousand dollars every month? If not, you just weren't that important to them.

Your CC company obviously has terrible customer service. Be glad you are rid of them.

I kept a balance nearly the entire time. I didn't pay a lot of interest, but paid some.

Oh well, I will fight it and see if I can get it resolved. If I can't, I guess I will just pay the stupid thing.

In the future, it might be useful to take down the name of the people you talk to along with the date and time of your call and notes on what you discussed.

Aside from the fact that you seemed to have lost your cool and had hasty demands that the rep. did not respond well to, the question is whether or not you are willing to pony up the funds for the two late charges. You do not seem to have independent proof to substantiate your claim that you properly made timely payments and thus should not incur late fees. You probably should just pay off the balance minus the $50 in late fees. Dispute the $50 in writing to the CC company and explain why without any of the animosity you have expressed here. Your prose should should sound objective and fair to a third neutral party. You want to highlight the call wherein one rep. verified that you had called on August 20. This leads credence to your claim that you had some sort of dispute. As you may not have disputed these charges in writing within the 30 (?) day window you may be SOL. Nevertheless it is not cost effective for them to collect $50. You would then need to dispute the amounts to the credut bureau.

It's a stretch, but after you take the advice of alrocky from above (and you should) you could call your representatives constituent services office. It's worth a shot.
