cpu overheating on new rig

I recently bought a new rig with a gigabyte GA-k8ns pro mobo, and an amd 64 3000 cpu. They sent it to me with a coolermaster sk8 fan. The cpu started over heating almost right away. It was running at 70 even in the bios, and the fan speed was maxing out at around 3100 rpm. I tried everything to fix the problem and still couldn't get the temp down. I checked out the fan online and it says its rated for the amd 64, however, it was not listed as a reccomended fan on the amd site. I had the company send me a new mobo, cpu, and fan. After installing the new components, I still had the same problem. I had planned on upgrading the fan anyways, so I ordered the thermaltake venus 12. Should this solve my problem?

Maybe the temp is being misread?

Is it possible they are not putting the HS on correctly?
 
Yeah, I thought it was pretty strange that it would happen with both setups too. Heatsink is in just fine. I know the temps aren't being misread. For one, I ran the gigabyte easytune and its getting the same reading as the bios, and after I run the pc for a few minutes and try to reboot, windows won't boot up properly i'm assuming because the cpu is too hot. If I let it sit, then it will boot up again in about 5 minutes. I first noticed the problem when I was playing a game, it would start skipping and then the screen would go to a garbled mess of color and it would freeze up. This would happen after about 30 sec. of gameplay.
