just got a new core 2 duo 6750 and a gigabyte P-35 motherboard. the stock intel fan randomly stops spinning, and keeps trying to start spinning again but cannot resume. my cpu temps are 42 idle.

checked newegg, no one else seems to be having this problem with the fans. is it even the fan? the motherboard? not enough juice from the powersupply? ive got a 520 watt

Why? I'm betting he's running stock - no O/C whatsoever. PWM is doing it's job. Fan spins when the CPU needs some cooling. Doesn't when it doesn't. If temps aren't running wild, don't sweat it. Instead, turn off the CPU fan alarm. Uncomfortable with that? Try switching fan control to "voltage" in your bios (instead of PWM) and see if that helps you. You turn motherboard fan control completely off, and I think your heatsink will run at 100% - a little loud.

Again, if it looks balky at startup, when the CPU is cold, I don't see that as a problem. Now if you run Prime95 or Orthos, and stress the CPU, and the fan doesn't spin? Problem.
