Court: No review of Obama's eligibility to serve as President!!

WASHINGTON ? The Supreme Court has turned down an emergency appeal from a New Jersey man who says President-elect Barack Obama is ineligible to be president because he was a British subject at birth. The court did not comment on its order Monday rejecting the call by Leo Donofrio of East Brunswick, N.J., to intervene in the presidential election.

Donofrio says that since Obama had dual nationality at birth ? his mother was American and his Kenyan father at the time was a British subject ? he cannot possibly be a "natural born citizen," one of the requirements the Constitution lists for eligibility to be president.

Donofrio also contends that two other candidates, Republican John McCain and Socialist Workers candidate Roger Calero, also are not natural-born citizens and thus ineligible to be president.


If find it mildly amusing that Donofrio would also lump John McCain into this group....

1. Did you miss the part where the court turned it down without comment? Meaning they didn't really look into as much as just decided to not bother at this time. That means this could still work its way through the court system, unless it has been thrown out by every other court.

"But this birth certificate business, this lawsuit that a guy named Phillip Berg filed in Philadelphia in August for Obama to produce his genuine birth certificate, and he still hasn't replied, he hasn't done so."

Limbaugh later added:

"And this birth certificate business -- I'm just wondering if something's up. I have no clue, and I -- folks, I'm telling you, this has not reached the threshold until now, and it's now popping up all over the place."


So it doe snot meet his standards, yet he keeps bringing it up. :roll:

This was the courts looking into it. There are just several standards of 'looking into it'. To deny something cert means that the USSC cannot even muster a minority of justices who think there is a chance of the case being determined differently than the lower courts decided. (ie: throwing it out)
