copyright question?

When I was younger, I wouldn't have even thought to ask about this - but here goes.

If I took a screen shot of my ipod touch and used the pictures of the icons cropped to web banner size as an overlay of a web banner (meaning it was faded into the background to suggest a techie feel) - would that be copyright infringement to use a pic of my ipod home screen?

I'm not describing it well - it looks cool though - it is overlayed on a 'rustic' scene implying the meeting of the new to the old. . .

Just curious about the copyright implications if any.

You were "younger" when the iPod touch existed?

If I understand this correctly, you're asking if its legal to use a copy written image on your web page without asking permission just because you took a picture of it and utilized that picture as the source?

In that case, no. You taking a picture of a copy written image does not absolve the copy write on that original content.

Doesn't sound like it would pass muster for fair use protection, so yeah, it is probably infringement.

But will anyone come after you for it? Probably not likely.

so your home screen on electronic devices have a copyright - sigh . . .

So any combination of ipod touch / iphone home screens that users have are copywritten? I'm just trying to follow - not argue.

Well the icons are (presumably). If you're holding your ipod in a picture, it would be fair use. But if you're essentially using just the icons, it isn't.

Did you draw every pixel of the home screen yourself, or is it displaying a bunch of icons that Apple holds the rights to?

What might be legal is to draw something that reminds you of the iphone home screen without exactly copying it, like you've probably seen clip art that is recognizable as an iPod or other device without being a photo of it.

Apple and app developer hold copyrights on the icons they created. The home screen is not copyrighted per se -- it is just composed of a bunch of individual copyrighted things.
