If not for the dash camera this guy would be in jail a long time. And the horrible drug in this case that required cops to lie to "protect" the public... marijuana.

"All the officers lied on the stand today," said Haberkorn, who herself is a former prosecutor, at the March 31 hearing. "So there is strong evidence it was conspiracy to lie in this case, for everyone to come up with the same lie."

This whole little cockup could have been avoided if they just got a warrant and executed it. There was obviously probable cause if they went so far as to cook up a scheme just to get this far. Any reasonable judge would have signed off on it.

I'm no expert, but it seems there were several by the book approaches the cops could have used to bring him in and search for drugs. I don't have sympathy for assholes trying to cut corners.

Sounds like there was a confidential informant involved who they did not want outed, or they came upon the information that there was a pound of weed in his car in a non legal manner.

This wasting everyones time and money over marijuana is beyond ridiculous at this point. War on drugs is welfare for the police departments and DEA. Nothing more.

"I wish it weren't so difficult to purchase illegal drugs" - a phrase never spoken by a drug addict during the last 50 years.

Desk duty? They need to be in prison for life.

Well, they are entitled to their day in court. But after they are found guilty of perjury they should at least serve some time to discourage other cops from lying.

Exactly. If there were *real* consequences for lying on the stand for an officer (or set of officers in this case), they might think long and hard before doing something like that. Instead of getting to sit at a desk, these guys should be in jail for 10 years.

Yep cop does it and gets caught... desk duty.

You or I and I bet the judge holds us in contempt at least.

Depends on the circumstances for the penalty.

If they were really trying to "protect an informant," they obviously went about the wrong way in doing it. If I were their judge, I'd get them half the max if that is the case, possibly less if it was shown that they took it up the ladder first and were advised to go ahead and lie under oath. Otherwise, I would give them the max.

i'd double the penalty for any offence committed by by a representative of the state.
and when i say double i mean 10x.

They will lie to turn anyone into a criminal if it suits their needs, to cover their own asses, etc. Some people would never get this.

If they don't lose their job their career is essentially over. They can never make a case again. Once you are caught lying on the stand your screwed for life. Anytime you ever get on the stand again it'll be brought up. Some guys get to hung up on winning every case. It's not hard to just say you don't remember and go on to the next one, been there done that several times. You may know he's guilty but it's not worth that one case to ruin the rest of your career.
