No pretty sure it's actually considered as bad as DUI. I THINK if it is open, it can't be within access of the driver but can be in the back or something, but I probably would not even chance it just to be safe.

Do they put ashtrays in cars anymore? I think they've done away with cigarette lighters now. They're all called "power ports".
