Exactly, he says killing anything is bad no matter what, he says guns are bad no matter what, I've never said either of these. it doesn't matter that there are many logical reasons for these to happen but to him, if he doesn't like it, it automatically needs to be removed from society.

Making alcohol illegal, it's dangerous, addictive people die from it!
Making tobacco illegal, it's dangerous, addictive people die from it!
Making caffeine illegal, it's dangerous, addictive people die from it!

On an even more frivolous note -

What?

If the majority of society thought smoking should carry the death penalty, would that be rational? It's just so irrational to assume humans will make rational decisions.

Oxygen has a valid reason for being. So does caffeine, in small doses. That's why massive doses are illegal.

Of course not, but how is my notion that "Humans make rational decisions in society" worse than your notion that "humans who made the constitution made rational decisions"...?

So why is a constitution better than democracy?

Did I say it was? It's different than democracy, maybe I view it as better, but that doesn't mean it is. We must have checks and balances to prevent the tyranny of the majority though and when played by the book, our constitution does a pretty decent job at it. There are things we have needed to amend and probably things further we will need to amend, but it's a pretty good framework to start from.

I do watch the news, I didn't hear about it, sounds retarded.

I just don't see the plus...? It's exactly the same as "tyranny for the majority", if the majority want it changed, it happens. I don't get it?

And we have the supreme court to keep us in line of following the personal liberty we protect in it. You don't really understand America it seems. Maybe you should do some reading up into a lot of the philosophies that our nation was built upon and some reading on how our nation is supposed to function.

The point is though, if 90% of the country want something to happen, it will. Regardless of the systems in place.

We have been down this road, and it leads to witch trials, war, and fear mongering. Individuals can be quite smart, but societies are stupid, petty, and fearful. All it takes is for one influential man to say that banana peels are dangerous because kids smoke them and all of a sudden people panic and ban bananas, a major source of potasium is removed from our diet, and people start getting sick.

These people who want to keep gay marriage illegal have the same view point you do on keeping heroin illegal, it's wrong and some people can't handle marriage so they shouldn't have the right to do it.
