So basically there is a store called Sharp Vision located in Maspeth, NY 11378
After first going to the store, Stephen Gaudio, the manager and optician of the store stated, after avoiding stating a price or brand name or any information about the contact lens charged me the usual (normal) exam fee. Then i was notified that my contact lens were $500 dollars which is practically double the usual rate. After further loud but brief disagreement and dispute threats over the phone the next few days, he settled for a $250 which is more close to the average price.
Then following the directions of the optometrist, James Gaudio, prescribed me a 1 year supply of contact lens of "high quality". I was given 2 white generic boxes (each contained 6 lens) After going through a lot of hassle to bypass all their blocks, the reluctantly given Rx prescription stated that the lens were made by Sunsoft called Eclipse Toric.
A third party store i trust (long distance, can't go to them
) took my information from the boxes (patent numbers), compared them with what he had in stock, advised they were for only 3 months, (2 boxes of Biomedics Toric). I confronted the store for the false prescription and incorrect lens which is probably illegal. They discussed it amonst themselves, then quickly and silently issued a refund and evicted me from the store.
I reported to The BBB. NY consumer affairs is asking what i want done because i already received a refund ( I want to revoke their license or have them investigated for fraudulent practice and at the least, false prescriptions. )
I contacted Coopervision, the maker of the contact lens. They located my order, basically said i should have received Hydrasoft's because Eclipse is discontinued and they will investigate on their end but i dont have high hopes that they will revoke the account as all they see is $$$ probably. They also stated i received Mediflex Toric which could be 6 months or 1 year. My third party store stated those were a 6 months supply officially, though if you want to be cheap about it, you can technically prescribe it for 1 year.
So, that means "technically", they did give me a 1 year supply but they gave me a false prescription which is why they probably refunded the money even though they knew it wasn't biomedics.
You think i should go as far as possible with this or i don't really have anything to stand on? I would like to go further, but i dont know what other channels are available. i also have a lawyer provided by my workplace, so i have that in my arsenal. I do have to pay for court costs and filing fees though, but the lawyer is free.... I don't quite know what to do with him. I can't find in google how to revoke a store license or optometrist license....
