confusion over downloading and riaa

Hey I'm still a bit confused over downloading and the RIAA going after people and suing P2P users, etc. The main question I have is are they just going after people that share files or are they also now going after people that download only but do not share with others?

I'd guess they're mainly going after people who trade (up or down, probably emphasis on up though) their biggest money makers - Ditzney Spears, the Backdoor Boys, etc. They're also going for shock value; kids & the elderly.

The reason I ask is I just recently downloaded a few songs with WINMX on dialup and since its allready so slow I have sharing disabled. I got some other stuff that I would like to download yet and I cant afford to take a chance with the RIAA. I plan on actualy buying the full album CD if I like what I download later on in a month or so because I'm straped for any cash right now.

If you cant afford a chance with the RIAA, dont do it, because then you'll really be strapped for cash. Just be patient and buy the CD.

If all you do is download wouldnt they just sue you for the cost of the cd's you downloaded? They wouldn't be losing millions of dollars of revenue from just you.. just the $20 they lost on you not buying the cd..

Its when people share that they lose money, if they lose any at all.. someone shares a song from a $20 cd, 100 people download that song, so thats $2000 right there.

Or at least that's how I see it.

They only moderate Kazzaa, I believe. The other hundred of completely workable and functional P2P programs are golden for use. 😀

I dunno about that. If I walked out of wal mart with a $20 CD, they'd sue me for more than the $20 i owe.

Yeah but thats a written law. They would toss you in jail and fine you under shoplifting laws.

Is there any concrete law on any books specifically outlining what the punishment is for downloading an MP3?

If you use BitTorrent, you'd BEST get PeerGuardian as well. Seriously, When I D/L something, I always see media companies, different divisions of the BSA, and MPAA attempting to connect. Luckily PeerGuardian blocks them.

They only go after the uploaders. The problem with targeting downloaders is that they would have to offer there music for download and it might be considered entrapment.

I heard that they were after a lot of people sharing tons of music/movies & even arrested some.
Well I agree that they target people who offer uploads and the problem with download is that they pin point customers via their ISP's. Whenever you download a big file from a website that is under watch you might even get a warning from your ISP to stop abusing the internet.
Bottomline is if you are a moderate user and don't share tons of stuff you might be ok but you are screwed if you get caught !!

Yup, torrents are now highly scrutinized.

DC is sketchy too. My university has been notified twice by the share-nazis that I share on their network, once for a T3 screener, the other for a JK2 .iso.

I suggest that everyone who shares download and run PeerGuardian. It's an IP firewall that I've heard is pretty effective at blocking the RIAA from seeing who you are.

I would only be paranoid about kazaa, and now I guess bittorrent. But as far as bittorrent goes, they would have to be actively searching for each torrent that they want to catch you on. And how many torrents are you on at once? I guess they could gather a list on you, but what if you have a dynamic IP... they can't really do much in the way of busting you big time on torrents.

When I was sharing about 200 movies, 600 tv shows, 4000 songs on kazaa, I got a letter from AT&T (att@home before the fall) telling me to stop sharing a cam of a movie that was just out in theaters. They mentioned nothing of my countless other shares.

Now I share all that crap minus the music all the time, and SBC hasn't said a word yet.

How many people have been busted? How many people trade? How likely are you to get busted? Not very.

Edit: Umm... yeah.

The Boy Scouts of America are now after P2P users? :Q

Better watch out now.....
