Company loses my check..

So last July 1st I had a total re-roof plus repair from hurricane damage done, offered the supervisor to come and pick up the check for $10,000, he declined since July 4th was upcoming and suggested I mail it in, which I did. Thing is, they NEVER DEPOSITED IT, nor have they contacted me about losing it so it must be marked as "paid" in their system. When I called the office about a supervisor's phone # (during the job) the secretary/office person replied "hang on, I'm really swamped here". This Co runs several crews and does dozens of roof's in the central FL weekly. Guess I should contact them and explain there is a problem, OR get that boat I always wanted!!(JK).

You know how that'll go they'll find the check behind a desk a day after you buy the boat.

Best to make sure they know before your bill is sent to collections agency and you get a few extra thousand in cost or place a lien on you. :D

I don't think so, they got the check and have not communicated with me since, TBH I have no idea what happened, probably just human error somewhere along the line.

I would definitely push for them to make it go through, if you feel they lost it tell them you're canceling the old one (can you do that?) and sending them another.

If not at some point it will bite you in the ass. Some kind of audit might come up on their end and they'll see that "you never paid" and then they'll send you to collections.

Yes, I could contact the bank and for a $30 fee issue a "stop payment" on the check. I don't think it would immediately go to collections since technically I didn't stiff them, it possibly could if once contacted I didn't pay promptly

The problem is what kind of proof do you have that you didn't stiff them if they lost the check somehow?

Just contact them and inform them it has not been cashed yet and see if they can find it and if not that's something you will need to do but you need to get a receipt this time as that was your first mistake.

Especially since you need that information for insurance and such and in case there are any problems with the roof for warranty information.

They were supposed to send me a receipt as paid in full once they received the payment but yea, kinda tough if a warranty situation happens and they look up the account and find the mistake.

I think you are going to screw yourself over and possibly end up in collections because you are hoping they won't catch the mistake and you will end up $10k richer. Whether they lost your check or not, you have no receipt to prove you paid them. If they haven't cashed your check, regardless of whether it got lost in the mail or they lost it or the dog ate it, you legally haven't paid them. This will not end well if you don't call them and let them know.

I know, I know, but I still don't see it as a collections deal, it's not like I didn't try to pay it but as already noted, if a warranty issue arises I'd be screwed. Or when they balance their fiscal year it would probably get caught and they will be genuinely upset I didn't notify them of the misplaced check.

You're making an assumption that they got the check. My assumption when it comes to the postal service is that they have dropped the ball. You can't make the assumption that because they haven't contacted you that they received it, recorded it but didn't deposit it. You yourself said they're extremely busy. I live in SW Florida and I know how busy these roofing companies still are a year after Irma. And you're right, they're eventually going to become aware of the situation.

My advice would be to go to their office in person. Someone standing in front of them is always going to get more attention than a caller or even a letter. If that's not in the cards, write them stating that you sent the check, blah, blah, the number of the check, so on and so forth and reiterate what you've stated here. In other words, CYA. Send it with return receipt requested so you know they got it and who signed for it.

A bank is not obligated to honor a check six months after it's been issued. But it's up to the bank. Writing them a new check with the old one floating out there could result in you being overdrawn. Only you would know if that's a possibility. Before I paid to stop payment I would reach out to them as I outlined above.

I don't think I would have trusted regular mail with a $10k check. Probably would have gone the certified mail route for that
