Common sense ruling in R.O.K. gun control case

http://www.uncoverage.net/2011/01/2...no-judge-throws-out-ca-ammo-registration-law/

In a dramatic ruling giving gun owners a win in an National Rifle Association / California Rifle and Pistol (CRPA) Foundation lawsuit, this morning Fresno Superior Court Judge Jeffrey Hamilton ruled that AB 962, the hotly contested statute that would have banned mail order ammunition sales and required all purchases of so called “handgun ammunition” to be registered, was unconstitutionally vague on its face. The Court enjoined enforcement of the statute, so mail order ammunition sales to California can continue unabated, and ammunition sales need not be registered under the law.

Kind of scares me to see reason in Kalifornia. Still, I'll take any victory we can get.

Didn't they want to fingerprint everyone who bought ammo?

Yup (well, thumbprint).

EDIT: I was wrong about the other part...just required recording the info on the ammunition package, not individual serialization.

Talk about going wayyy to far. I think even most anti-gun people agree that having to be fingerprinted to buy ammo is crazy.

See my edit above, I was wrong.

It did have bits about forbidding anyone with gang affiliation from possessing ammunition however, or allowing ammunition to transfer to such a person.

Unconstitutional law was unconstitutional. So is the whole law thrown out or just the cross state lines/mail order stuff? Good to see the NRA doing more good work, seems they've been wussing out here lately.

It's because they decided decades ago that partisanship was the answer instead of rationality. They've paid for it with their inability to get anything done. The ILA is finally bringing reason back to the group.

The entire thing was thrown out. Unfortunately the reason given was it was too vague since it didn't actually define handgun ammo. The CA legislature tried to pass a bill that changed it to actually define handgun ammo - the list included 5.56x45mm, 7.62x39mm, and ".9mm" among others o_O, so they'll probably just pass it again with handgun ammo defined.

I don't think anyone would bother spending money on 0.9 mm ammo anyway. I'm not a gun expert, but I'm guessing that would buff right out. :p

Even though those are rifle calibers, except of course the .9mm, hehe, they could get away with calling it "handgun" ammo because a popular trend is shortened pistol versions of AR and AK rifles, short enough to make pistol, but with no butt stock, or fore grip allowed lest it becomes a SBR.

So, guns are less regulated than say, cars?

I'm glad the country has it's priorities set right.

Strange.... I don't recall having to pass a background check by the FBI (NICS) when I got my driver's licence.

Off course that background check still didn't give you permission to actually carry it around, for that you need another background check, fees and a license ...in most places. And if you want something more fun, and other than the pre-approved semi auto handgun, rifle, yet more background checks, and even higher fees.

Tell me about it: I live in NJ, where you can have an unloaded and locked weapon (which you are, of course, registered and licenced to posess) in the trunk of your car, and still be thrown in prison for 7 years.

Yah - Someday I hope the career works out so I can move. TX is too flat (ex has family near Sanger). Eastern Tennessee looks like a pretty good spot...

Yea, for the most part it is way too flat, long drives are boring as hell.
