i guess that's why out of the billion people who drink coke, the number of people who get cancer from benzene is what? you can't prove benzene from coke causes cancer. living life itself causes cancer. a drop of benzene in a soda pop will NOT give you cancer.

So first you say we shouldn't warn people about everything and sue companies for negligently harming their consumers without warning, now you're saying it doesn't matter because in your quite informed medical opinion benzene won't cause cancer... so which is it?

I never said companies shouldn't warn people. However, it is unreasonable for someone to sue coca cola because one of their preservatives in rare cases can react with other foods you ingest to form benzene to cause cancer. The lawyers on this case don't give a fvck about cancer; they just want to make money off it.

Pick a fight and stick with it. Where did I claim benzene does or does not cause cancer? Can YOU prove it? I'm leaving that up to the scientific community involved in that sort of research. All I'm saying it lawsuits like this are sometimes necessary to make the general populace aware of risks they may have not understood before. But that is obviously given that the scientific community has proven it is a notable risk and has no bearing on my point either way.

And when you order coffee from McDs its hot correct (or should be), common knowledge right? Then why did McDs get sued by some lady when she put it in her lap and spilt it. McDs lost and now has to warn people that coffee may be hot.

People are stupid, common knowledge goes with common sense, people dont have it anymore so they sue instead. You did not tell me the coffee was hot, so it's your fault i am a clutz.

ok dumbass say 10 years from now you come down with squamus cell carcinoma and it was traced to the city water you drink becuase they still had lead pipes and the city did not inform you of the "potential" danger. so now you are the ignorant one for believing that what you were consuming was safe. so now you play ignorant, hire a lawyer and sue. have fun.

So what? I think that lawsuit was wrong. You do realize I, or anyone else, can be for one lawsuit and against another, right?

umm.. how am I a dumbass? I know that there is a possibility of my health risk of consuming products.. including city water.. When I wake up in the morning, my day begins with health risks.. Should I go out and sue every company that has a product that I use or consume?

Don't come in here flaming me, and defending the case of consumers claiming ignorance.. dumbass

They were told to lower the temperature of the coffee because it posed a serious health risk to people at it's temperature. They failed to do so, some lady spilled it on herself, and as a result of them not complying with warnings, was given 3rd degree burns from a cup of coffee.

Nice spin though.

It's one thing to disagree with a lawsuit based on facts (which in that case, I felt indifferent about), but it's another to blatantly spin things like you're trying to do.

some one was giving common knowledge things as reasons to sue, i put another one out there, just saying there is alot of bad lawsuits out there. Like everything in society there is good and bad. And anything if consumed too much will have ill effects on you. For instance, too much Vit C causes sorisis(sp) of the liver, just like alcohol, do orange juice makers need a label on that product too.
"dont drink too much or your liver will become overloaded and shut down."

Thats the truth.. just looked up a little info on that case.. Apparentlly some McDonald's managers were ignoring the warnings and kept the temperature of the coffee at the temps that were posted in McDonald's training manual.

But it all goes back to common sense, if she would have used a cup holder her lap would not have been burned. And is that what lawyers do all the time, spins the facts to how they want the verdict.

I'm not going to call you a dumbass, but your point is simply ridiculous. People should be made aware of risks they may not know are there. When people drink soft drinks they know they may them fat or corrode their teeth, but they are aware of these risks and can choose to accept them or not. But they people that decide that they are fine with these ricks or choose the path of moderation may have no clue it could cause cancer. I see no reason why the public shouldn't be made aware of generally unknown risks, that is not in any way an unreasonable expectation for the public to have in relation to the products they consume.

Did you even read my post? I would agree that it would be unreasonable for someone to try and sue claming they didn't know regular sodas could make them fat or that they could corrode your teeth. These are things that are common knowledge these days. But the risk with cancer and benzene is not common knowledge. It's a risk that the mojority of the public is not going to be aware of and therefore can't be expected to make any sort of choice for themselves as to whether they accept that risk. Ignorance is a very real excuse here.

Your point is tantamount to saying, "Well, everyone knows you can die in a car wreck, so even though the public wasn't aware that one brand of car blows up when you turn the key they shouldn't be allowed to sue because they knew cars were risky". It's a very weak argument.

Seems to be a bit of a logic loop going on here. Benzene does cause cancer. Its been proven. However what is happening in softdrinks is preservatives are being added sodium bezonate and potassium bezonate that react with Vitamin C to form and Acid that breaks down into Benzene after it has been in the drink for a while.

I'm pretty sure the preservatives were not in the orginal Coca Cola recipie

http://www.cfsan.fda.gov/~dms/benzdata.html heres a study from the FDA, they say Benzene is unsafe. Looks like Safeway, Sunkist and Giant brand stuff is killer.

First, I don't think the general public has been educated about this. Second, bezene isn't an actual ingredient. It apparently results from chemical reactions after the coke is produced.
