Class Action against Apple?

it seems like every ipod-mini's battery will die before it's planned death date due to a faulty recharge sensor, and apple want's to rape it's customers of $100 to fix it. why isn't there a class action lawsuit in the works???
 
unless it dies 6 months after you buy it, there's nothign saying a lawsuit is in order against a battery that fails a few months before it's expected life expectancy(it's like 4 years or something right?).

well i got my mini as a promotion through citibank, so i didn't pay anything for it other than locking up 1500 of my money for a year
