HEY!

I am writing a book on child custody problems (problems with judges, custody decisions, etc) along with child support issues.

1. What is unfair in your state?

2. What issues have happened in your case?

3. Is one parent favored over the other?

4. Child Support problems (with the state, county, unfair amount to pay, etc)

5. Any unjust thing that has happened to you.

**This is to be put in a book that i am writing specifically about Fathers Rights, but I am interested in hearing all kinds of problems. Understand that I will do research to see if what you say is valid. Any documentation that you can send me is appreciated (court filed docs, etc).

Why am I writing this? Because in NC the guy is screwed and I want better equality for the children and parents. Children have a right to see both fit parents and parents have a right to provide adequate support (not for the mother but for the child).

I know I am going to piss people off with it, but the facts need to be known.

In my home country of California, you can go to jail for kicking a baby further than 8 feet!

i have a cousin who was having his child support taken right out of his check, sent straight to the Atty General who paid his ex.

this went on for many years.

turns out, the AG made a mistake and he was behind 2 weeks all those years. So, they charged him back interest.

what a rip. even when he tried to do his duty, he got screwed.

Also, he was required to pay for med/dental/vision coverage for the kids, while his wife could have carried the kids on her plan (remarried + another kid) for free.

UCCJEA is a huge part of child custody these days. I wrote a paper about for my family law concentration. I think the law should most definitely be discussed.

In my dad's first marriage (I was a product of his second marriage) they got divorced and both agreed to let my dad have custody of their two children. The divorce happened in New York. A few years later my dad moved to Oregon.

One day when the kids were in the first grade or so, his ex-wife showed up at the kid's school and took them back to New York with her. She basically kidnapped the kids.

The state of Oregon said they weren't willing to spend the money to pursue the case. My dad tried every avenue he could (lots of lawyers at the company where he worked), but they weren't able to get much cooperation out of the Oregon government or the New York government. A few years later, the mother dumped the kids off with my dad again.

I guess a lot of ATOTers are idiots then...including me.

OP, I used to enforce the collection of CS arrears and heard all the stories before. Mostly guys ranting about how their ex has remarried and still gets 50% of his gross income.

I have 1 1/2 years left of child support. I live in NC now but was divorced in Washington State. I took a risk and signed over custody to my ex and we worked out the actual custody on our own, unfortunately this leaves me vulnerable as she has all the legal rights, but she has never kept me from my daughter.

She did screw me over on a mobile home that was a family gift to me (before we were married), when I sold it she demanded half the money. Since it was located and titled in NC she got half.

You'd save a lot of time and effort by writing about the parts of the "family justice" that ARE fair. It could be written on a napkin.

I'll update this post as I have time.

Retroactive payment adjustments: When a man pays too little in child support, say he gets a raise, he will be found in arrears and will be expected to pay any back support he may owe. When a man pays too much, say he loses his job, well that's just too damn bad. He'd better figure out how to come up with the money.

The bolded part is what I am going through right now as well. The price of insurance nowadays is rediculous. I am paying more for insurance that isnt being used than I am for child support. I dont mind paying for something my daughter needs, but wasting money like that is frustrating.

Other than that, just some of the same headaches other dads have.

My parents divorced in 1980, when I was 1. I always lived with my mother. My dad had support garnished from his wages automatically. It was $50 a week. He paid that every week until I graduated from college. I was on his dental and medical insurance, although my parents both worked for the same employer so that really didn't matter much. I lived with my mother and saw him every week on his off days, and since he lived no more than 15 minutes away it really wasn't that big a deal at all. Technically, he was responsible for half of all my education expenses, and half of anything else that would have happened during my upbringing, but my mother never tried to enforce that or ask him for a penny when it came to tuition or anything else for that matter. don't get me wrong. he did give me money for things all the time, so it's not like the $50 a week was all he contributed. he really didn't complain about that too much, because he knew that he didn't want to piss my mom off enough to the point that she would take him back to court to force him to live up to the terms in the divorce decree. I was in Indiana by the way. So, I guess the whole point I'm going for here is that a judgment or condition dealing with child support is only of any significance if it's enforced.

I am going through these as I can. I will talk to each one of you. My first person that I want to address is the one regarding insurance.

What was the courts reasoning that he provide the insurance? What was her job stability? Did she switch jobs alot?

I will address everyone else in a few.

Are you planning on paying people for their research? If you're only interested in documented, sourced material rather than opinions, it sounds like you're trying to pass of the research work on us. :confused:

agentbolt - I said I will do the research to see if what you say is valid. Any documentation that you send me is appreciated. My this I mean, I will look into your case via court records. If you already have those and can send them to me that is great! If not, I will get them on my own.

I am trying to change the system so Fathers have equal rights in court. Yes, it says they have equal rights, but the Mother is presumed the care giver. This should never be done. Custody should go to the parents that are fit, if both are equal custody should be upheld unless parents agree for another method.

Judges should NOT take away fathers rights just because they are a man. A man should not pay 50% of his gross earnings for a child. NEVER!

If a man pays for insurance and his wife can get it for free, then why is he paying? COMMON SENSE IN THE LAW AND IN COURTS WILL GO A LONG WAY!
