You're right, that's a hawk.

So I take it the hawk grabbed the snake and the snake then wrapped its feet up? Guess the hawk could have eventually reached down and bit the snake a few times.

I have had similar encounters with animals...and I have found they seem to understand your good natrue when doing something to help them. By no means is this all the time, but I would take the chance. Not to mention, I have witnessed owls fly with some rather large prey in there claws. Wonder if he just could not get up, or was paralyzed?

By no means is this all the time, but I would take the chance. Not to mention, I have witnessed owls fly with some rather large prey in there claws. Take the chance and get bitten by a poisoness snake?

 
A snake that small doesn't have teeth long enough to bite through the thick pelt of feathers. Even if it did manage to get a fang in at a weak spot like the legs, the coloring doesn't look like any specific venomous snake that I know of... I highly doubt the snake survived being all wrapped up in talons like that with no defense or offense.

Well I am not sure what kind of snake it is, so I would be quite careful to begin with. Obviosly photo taker wasnt to alarmed as the distance he is away. Without violating any animal cruelty laws or what not I generally am not very friendly towards said reptiles. Besides, Anti-Venom is locatted close by at the hospital 😛
