I admit I kind of feel for the guy. It was obviously a mistake. But the law is the the law and now he is facing 3 years in prison on a felony rap.

MILWAUKEE (WITI) — A Milwaukee parent is accused of bringing a loaded firearm into Riverside High School. The man is a concealed carry permit holder who says he entered the school forgetting he had the weapon on his person.

40-year-old John Guyton has been charged with possession of a firearm on the grounds of a school — a felony charge.

Milwaukee police officers on March 13th were dispatched to Riverside High School for a gun complaint.

Officers spoke with the school safety assistant assigned to front door security. According to the criminal complaint against Guyton, the woman told police she observed Guyton, a parent, enter the school, sign into the MPS log book and walk toward the scanner. The safety assistant told police the man then grabbed at his right side waistband area, turn quickly to his right, and run out of the school.

The complaint says the safety officer told police she observed Guyton place an object under the front passenger seat.

The complaint says the safety officer stopped Guyton at the door as he attempted to re-enter the school, and told him he could not enter the school because she thought he had a gun. The complaint says Guyton told her it was not a gun, but rather a switchblade he forgot he had.

Police were able to recover a firearm from the vehicle parked in the school’s parking lot. According to the complaint, the firearm was a black Glock .40 caliber loaded with 15 rounds in the magazine and one in the chamber.

The complaint indicates the firearm was previously reported stolen.

Police spoke with Guyton, who said he had come to the school to pick up his daughter, and had forgotten he had the gun on his person.

Guyton is a valid concealed carry permit holder. If convicted of the felony charge against him, Guyton faces a maximum of three years and six months in prison, and/or a maximum of $10,000 in fines.

Concealed Carry is new to Wisconsin, so he may not get off easy.

What a dumbass. He practically guaranteed his conviction by hanging around and admitting his crime to the police.

That said, strict liability laws are terrible. Nobody benefits from giving this man a criminal record.

This confuses me. Was it his and he had reported it stolen or was he in possession of a stolen firearm?

Also, not responsible enough to know you're carrying a gun into a school, I lose my sympathy.

Sucks for him. Hopefully they won't throw the book at him for his forgetfulness since he wasn't going there to shoot up the school, but this could still be a life-ruining brain fart for him

This confuses me. Was it his and he had reported it stolen or was he in possession of a stolen firearm?

Also, not responsible enough to know your carrying a gun into a school, I lose my sympathy.

I'm guessing he reported it stolen then found it at some point and might not have reported he found it. They should have put more details in the story

If you're not aware that you have a gun on you before you walk through a security checkpoint, I have a hard time believing you're going to be aware enough to use it in a timely manner if needed. I've carried a firearm more than most here, and I've never bought into the whole, "you just forget it's there" claim.

This is why a person that has CCW license/permit should have a lock box in their vehicle. It only takes a minute to place your pistol in the lock box prior to entering a place where weapons are not allowed.

I'm with Nebor on not buying a person forgetting they're carrying a weapon. Even my Beretta Storm PX4 subcompact weighs close to 2lbs loaded.

Wow, way to play it off cool man.

So the school safety assistant calls in a gun complaint even though the guy returns and I am assuming goes through the scanner this time with no gun? What an ass. Did he think he was just casing the joint and going to comeback with it and start firing? And did the police get a warrant to search the car?

I am guessing he reported it stolen for insurance money or crime reasons? Or he stole it?

Either way just adds to him not be a very bright bulb.

Assuming he didn't steal the gun, I can't see any reasonable judge nailing this guy to the wall. It was plainly an accident. Nobody was harmed. I hope the judge has some discretion in how to handle this.

Wow, this is some fucking moron.

I don't buy the "forgot" bullshit excuse - he knew what he was doing, he just wasn't quick enough to realize he could get in trouble. And too lazy to leave the area and secure the gun.

Doesn't matter, he should have left.

I am not looking at it from the perspective of "what if someone broke into the car and a child got shot?!?"

I am looking at if from the perspective of "this is a firearm that was reported stolen, I am in a no fire arm zone and I need to get the fuck out of here."

He should have bolted,... plain and simple - I don't care if he threw it in an ocean; it sounds like he is carrying a hot peice and wanted to hide it before he got busted.

edit: sorry, I mean secure in the sense of him not getting into any trouble.

dumbass, and a stolen status on the gun? He deserves something, don't know what is appropriate but for sure he needs a reality check

He wasn't arrested for having a gun in his car. He was arrested for mistakenly carrying it into the school, noticing, and then securing the weapon.

Again, where is the mens rea? This appears to be the case of punishing someone for attempting to do the right thing.
