Carmax Screwed Me Over

I bought my mom a 1999 Nissan Maxima gxe from Carmax a year ago and they told me it had ABS. I still have the window paper that says it includes ABS. I just found out it doesn't have ABS and this was an $800 option. What can I do if anything? She told me to check it out if she had ABS or not because it was raining and she didn't think she had it. She was right.

I think I am out of luck. The manager said the window stickers have a disclaimer on the bottom that basically says they are not always right, but he told me to come in to talk to him anyways. They did tell me it has ABS when they sold it to me.

You think they will do this? My car is not paid off by the way.
Trade my car a 1999 Maxima GXE 42,000 miles for a 1997 Maxima SE 75,000 miles
SE has more options (spoiler, wheels, sunroof, fog lights, better suspension, etc).
They sell them for pretty much the same price on carmax.com but mine is selling more. What are the chances they will do a trade?

Horsesh!t. That's like saying "We can lie to you and get away with it". Nail these assholes for fraud. What if you slammed on the brakes expecting ABS and instead killed a busfull of nuns or Girl Scouts or something?

9600 on a 3-year old car also smells funky. Check VINs, run a Carfax of your own.

From what the manager said, they don't seem to be obligated to do anything. However, it may be a better deal for him since he is getting a newer car. Who knows....
 
Keep your car, drive slower in rainy or low traction situations.

Write an email to carmax HQ and express your disappointment in the false advertising. Use the NADA book to determine how much ABS adds to the resale value of the car. Request that as a refund.

ABS is nice to have, but not having it isn't the end of the world. Not worth getting an older, higher mileage car for that reason...
 
Consult a lawyer. Disclaimers don't always hold water.

Didn't you ever slam the brakes or look for the ABS light on the dash?
 
if the salesmen said it had ABS and it does not then you can go after them.

If it was me i would consult a lawyer. If they lie to you to sell a car that is fraud.

I would NOT trade in a newer car for a older one with more stuff. anyway IF you have aloan on the older car you cant just transfer the loan to a new car. you have to pay off the orginal loan and take onother one out for the new car.

Ever heard of pro bono? Ever heard of small claims court? Ever heard of free consultations?

Is this "window sticker" the Monroney label from when the car was new? If so, those are not allowed to have any errors on them whatsoever and there is no disclaimer on the bottom. Does the VIN on the Monroney match the VIN on the car? I would check because if they don't then you are the victim of a classic bait-and-switch. You have very little recourse, however, except to file a complaint with your state's attorney general.
And you should like no way in hell trade in your newer car with low miles for an older car with higher miles. Try not to victimize yourself, eh?
