car insurance question after accident

Saw a cop at a yellow (sigh, again)... I stop in time, in the rain... but the woman behind me nails me... she fuct up her hood while I got minimal dmg to my muffler / license plate.

Cop was right there and wrote up the report... but he says we should both call our own insurance companies and have them talk to decide who's at fault. That's not what I understood from what others have said around here.

I don't care what happens or who has to call who, I just don't want my insurance going up because of this... so what is my responsibility here ?

Whatever the law is in NY. You most likely have to report the accident to DMV, and SHOULD report it to your insurance company. She rear-ended you, so the accident should be charged 100% against her, but IMO, you need YOUR insurance company involved, to look out for your interests.

Call insurance company. If you don't file a report and she does, it is your fault for an accident that was her fault. Also, by not filing it, she could sue you for damages that never even occured.

It's hard for me to understand car insurance questions without Bert Bacharach singing to me or mini-me chiming in.

She hit you, so it should be charged against her insurance. I would actually call HER insurance company to report it and only notify your own if you don't seem to be getting anywhere with them.
