Okay, here is the scenario:

Girl 1 gives an unliscensed driver, Girl 2, the keys to her car and says she can drive down to the local 7 Eleven, which is about a block away. Girl 2 goes and picks up 3 friends, drives for about 20 minuets, then hits a post and flips the car. Two passengers suffer moderately severe injuries (broken leg, possible concussion.) Who is at fault, the girl who lent her the vehicle (Girl 1) or the unliscensed driver (Girl 2)?

Girl 2 is legally liable for everything. Girl 1 should get a good a$$ chewing from the police, but Girl 2 was the operator of the vehicle in question. Girl 2 should not have been driving in the first place and should have known better.

in california, girl 1 is the person legally liable for all damage, I believe girl two would have some form of punishment such as revocation of license privalege and such.

Girl 2's insurance would have to pay if she had a license, but since she doesn't, she gets ticketed, both get sued, they all end up on Judge Judy.

if Girl2 takes the responsibility (legally and pay the $) Girl 1 should be alright

if Girl2 dont take that or pay the damage

both goes on court

Girl1, she was responsible to let an unlicensed driver drive the car, should know better.

They both are. Girl 1 is jointly responsible with Girl 2 because she knew she was an unlicensed driver, and therefore an accident was foreseeable. In some states, she can be punished to the same degree as Girl 2 (criminally, I mean). Girl 2 for the obvious reason. In Wisconsin at least, Girl 1's insurance would have to pay any damages that fall under her coverage, because she gave Girl 2 permission to drive her car - if Girl 2 had simply taken it, then Girl 2 would have to pay up. Girl 2 can still be held responsible through civil court for pain and suffering and whatever Girl 1's insurance doesn't cover.

i dont think Girl1's insurance will pay since Girl2(the ACTUAL DRIVER) is NOT insured.

if you have someone non-insured driving your vehicle, your insurance just wont pay
i think it as simple as that

Girl 2 is at fault but Girl 1 insurance should pay the damages because Girl 2 was driving here car making here a tempary driver.

Oh by the way how the hell do you have a no fault state about car accident involing one car? Well I guess a person is reasonsible for any thing any more.

Here in Oklahoma, it's both.
Girl 1 because she allowed an unlicensed driver to drive the car, and Girl 2 for driving w/o a license. She probably won't be getting her license anytime soon :). Girl 1's insurance should repair the car, but not the passengers..... I wouldn't be surprised if this has to be settled in court.

Not here in Oklahoma, its a "Big" crime to allow an unlicensed driver drive, however it's not really regulated unless some kind of Car accident happens.

i seriously doubt an insurance company will pay ANY accidient if an UN-INSURED USER was driving the vehicle

i dont think there is something called 'temperary driver'

Unless the keys were stolen from Girl 1, it's all going to come home to roost with her, sooner or later. In the civil court however they could go after anyone/everyone, including the 7-11 she was supposed to drive to but didn't.
