Car Accident: Preliminary check for $4,700 *Update*

Hey everyone..
OHH NOEESSS !
I was involved in an accident Sunday morning. I was coming down a one way street and making a left onto an intersection that was a regular 2 way street. Sun was shining in my eyes so i was going slowly. I had a green light, i signalled and executed a left turn. I was totally strait and in the new street when the collision occured. The next thing i know is that i am perpendicular to the lane of travel on the street i just entered. The other guy hit the vicinity of my rear driver's side tire and spun me around and i didnt stop spinning until the front bumper hit his car. This guy was behind me! I honestly don't know how he didnt see me turning.. He tried to cut me off somehow. He was also wanting to turn left i believe. If he was going strait, he wouldn't have even been close to me.. He must have been speeding.

I filed a report with their insurance company and notified mine that i did so. The police were at the scene, but the cop indicated that i was in the center lane of that one way street and that the other guy hit me. I guess the other guy fed the cop a story of how i was in the right lane of the one way street and cut across his lane to make a left. I hope that this 'center lane' thing doesn't mess things up in making his insurance company not accept responsiblity for the liablity so my premiums don't go up. I tried to have the cop add a supplement to the police report, but it was no good.. The impacts on both cars and where i ended up should be sufficient to prove that i am in the 'right'.. I hope so.

Cliffnotes Some guy hit me close to the rear passenger tire and spun me round so the whole side of my car hit his :(

Oh yeah. i had a full Dunkin Donuts hot chocolate in the center console that lost its lid during impact and is splashed all over the carpet and seats .. etc.

So, plz provide advice, suggestions, comments, and guestimates.... and moral support.. cuz im bummed ! :)

Update 1 The other guy was a college kid driving a small chevy and was delivering pizza... not that is means anything.. just something i forgot to add
Update 2Appraiser is coming tomorrow morning to assess damage and cause.. etc. will let you know more when i know

I didn't get to talk with their appraiser, he just came to my apartment building, checked out the car (which is parked in the far corner now), and left. I received an accident form from their insurance company to fill out. I talked with my agent, and she said that even thougt it wasn't my fault, and becuase of the point of impact and the police report that sides with the other guy, there is a small chance that the claimed would be denied completely. Chances are it will be 50/50, in which case my premiums won't go up in the future. There is a tiny 0.01% chance that they will accept liability like i want. My agent has had 20 years of experience and knows probably what will happen.. So, i will fill the form out on Sunday, mail it on Monday and hope for the best.
Update 4 2/4/04
Although i have filed a claim with the other party's insurace company, the appraisor from my insurance company, Nationwide, came to look at my car. If they end up getting involved (a.k.a the other insurance company denies my claim to any extent) they need to have an active interest in this collision by law to be invloved. So he looked at outside damage and cut me a preliminary check for just over $4,200. That's $4,7000 minus my $500.00 deductible. I won't be depositing this check. Just holding it. Now they have a lawful reason to be involved. He said, I should probably have my car taken in to be repaired now and call him when the Lexus dealer has the car taken apart so he can get the entire damage estimate. I know there's hella more damage !
I am on my way to take pictures of the scene later today if I can squeeze the time. I think it will help my case because the roads are very narrow. I have been very busy with other things. Work and family related.. so i will post those pictures for your opinions when i have the chance.

Just happened.
I filed a claim with theirs.. adjustor called me and i told her the story. I also notified my insurance comp.
I haven't taken it for an estimate yet

I have nothing constructive to say, nor can I help w/ the price. But you got the rear view pic and side view pic backward.

They have a frame of sorts. There is usually a rear and front subframe and the body cage acts as the center part of the frame. Althougth they do not have a full frame like a truck (no cars do anymore) it is proper to refer to structural damage as "frame damage" as the entire car is basically part of the frame. I just had one of my 66 Mustangs' frame straighened at the frame shop and it is a unibody car but the guy doing the work still referred to it as "straightening the frame".

Billy Bob's Back Alley Body Shop will probably fix it for $300 or so. No guarantee on the work, though.

But they use silly putty, white out and sledge hammers to fix damage.. i dunno about them :Q

Does estimates take account for the model of cars? For example, Lexus would cost more to fix then a 96 Camry or something like that?

Rhode Island has comparitive liability where both drivers end up assuming a portion of the damage if necessary..
I'm screwed I think !

definitely. the more expensive a car is, generally the more it costs to repair, and the pains are even usually better with special processes and paints.

13,000 sounds like it's in the neighborhood. maybe more. a guy i know with an is300 had similar damage but a little more severe. the front wasn't misaligned but the trunk area was. if i remember correctly, it cost him about 13k to fix it. if they do give you the option to repair it and you decide to go that route, i would do lots of research on body shops to find the best one.
