Capture and Trial vs. Capture and Kill

well, I was watching THIS WEEK this morning on abc, and they brought up the topic of Bin Laden either being captured and then being given constitutional rights and being tried. Some actually supported this, while others were saying that it would be best to simply kill him if they found him.

What are you're thoughts? I personally think he should be killed once found, if he is ever captured and given trial, it was be a nightmare here. protestors up the ass, riots perhaps, assassination planning. so many events.

We can't have double standards. Why do people worry about trying him? Capture him, try him, ANY jury here in the U.S. will find him guilty and execute him. But he's not gonna be taken alive anyway, so I'm pretty sure once special forces catch up to him, he'll be toast.

I think we ought to capture him, shave off his beard, parade him in front of cameras, and then kill him.

If he's killed in a capture attempt: fine, he got killed in a war.

If he's captured: What exactly are you going t put him on trial for? He wasn't in the US when he did anything, andd therefore isn't guilty of voilating any US laws. It'd be akin to coming back from amsterdam and being arrested for possession of marajuana.

However, I can't see him allowing himself to get captured. If we find him, I'm sure he'll be KIA.

My friends and I were joking that we should do a nationally televised stoning, with stones being donated from school kids across America. Each kid would put a message on it and it would be read on TV before thrown. We were all laughing that 99% of them would say "F_ck you"

"And here is one from little 3rd grader Rachel Stevens, which says (in a little girls voice) "F_ck you Osama!"... THUD."

I'm torn personally. I would think that seeing Osama in prison orange attire, in shackles, having to take little baby steps to walk, with his BEARD SHAVED OFF, like a common criminal, would really be demoralizing to many extremists or budding extremists who see this. It would sort of prove that even the 'Great Osama' is not indefeatable as many young extremists view him. I am not sure that we want to 'martyrize' him, which would really play into their mantra. I don't know.

Unlike many people here, I'm NOT a lawyer, but I think you could probably find precendent. Noriega was brought to the US and convicted of drug trafficking, although I think he was actually arrested in the Canal Zone, which was US territory at the time.
Or some kind of war crime tribunal would probably be doable...

It's like this.. I'm all for capturing him and trying him, but I just doubt it will happen. I'm willing to bet that the special forces have been given orders to shoot on sight. Basically, shoot first and ask questions later. Shrug.. if that's what has to be done, then so be it.

Actually we can very easily try him here. He was behind the attacks on the United States which took place on US soil therefore it is in our jurisdiction.

Military court is the way to go if he is going to get a trail.

Lets talk about what might happen:

bin laden might hire ojs dream team and get off(highly doubtfull)
He might get life in prison and we spend the rest of his life dealing with people doing terrorist acts to free him.
He might get the death penalty and spend the next 20 years there with apeals.

And the #1 reason why a secret military court is the way to go:

Terrorist might do bad things to jurors/lawyers/judges during his trial.

The cheapest way is to capture him and kill him, since he will have many body guard around him and will be hard to take him alive.

But if we get him by chance, (very unlikely) we will probably want to try him and shave his beard, force him to work in the prison till he is old enough to die with pakinson disease ( so he will never be able to die in a Jihad and go to his "heaven" ).

This will be a slow and painful turture for him, in stead of a quick and happy death in his Jihad.
