I have a hitachi deskstar i purchased this summer. the problem is that its going bad so i was gonna rma i check on hitachis website they said to return it to the place i bought it. well they place i bought it went out of business which is why i got this drive for dirt cheep. what should i do?

After thinking a bit more....where did this hard drive come from originally? I have had a few drives that were system pulls and NOT under warranty, even though they were only a few months old. Most drive mfg's have agreements with OEM PC builders to handle all RMA's internally. :(

yup, the reason you got it dirt cheap is because the warranty was only to be handled by the distributor, not the manufacturer. And since they are out of business, you'll have to write that one off as a loss.

Sounds like a near-new drive right? I think there are situations where the maker is required to replace the item regardless of warranty, such as a DOA or obvious manufacturing defect. I know someone with a toyota which randomly blew the flywheel (could only be explained by a crack or defect present from the factory) and toyota paid a significant proportion of the repair cost to avoid court. This is in the UK though, does it apply in America?
