Hi guys,

I need help. I sign a contract to receive allergy shot at $150/vial and I needed 15 vials. At the time, I thought my insurance will cover it, but since it's a saturday, and I cant call and check. I signed it anyway stating that I have agree to the treatment and I'll bear the cost of the shots even if I decided to not to go through the entire treatment. (Yes I know!)

Now that I confirm my insurance dont cover it, it's too expensive; I dont think I can afford it. Anyone know if it's possible to get out of that contract?
 
If you were not sure, then why sign in the first place. You could have waited a day to check.

That attitude of declining responsibility for your actions is dangerous.
 
EagleKeeper, Im well aware of that mistake. I know you and every other ATOT users love to scorn at me, but please, offer some good advice.


 
That is the good advice, don't sign a contract unless you are sure you can honor it. Anything less is dishonest. There is no way you are going to come out of this without paying money, unless you are really good friends with a lawyer.

There are plenty of more expensive life lessons to be learned, so this one is a relative bargain. 😛
 
I doubt theres a way.. i mean if you hired a lawyer, it'll end up costing you more.. they can sue or collect.. you can always say your allergic to the shots..

Do you own, or could you procure, a flux capacitor?

If not, my advice is to ask nicely.
 
Call up the palce and let them know the situation. See if they will let you out of it. If not, see if you can call an attorney since most will give you a quick 5 minute phone conversation for free. Also read the fien print on the contract to see if there's anything stated as to how you can get out of it.
 
Once you sign, you are pretty much committed. Your best bet would probably to speak with the other party. Maybe they'll let you out of the contract. If they are hesitant try offering to pay a fraction of the remaining contract and see if they'll let you go. A good business will do that. But of course, this doesn't sound like a good business (forcing you to sign a contract for health care is shady).

Here is my advice - you signed a contract. If it has no escapes clauses than you are obligated to pay. If you choose not to pay and not have the shots done, then they might choose not to pursue you since they can administer the shots to someone else and not lose money. Otherwise you will lose in court and will be required to pay at least $150.

Have you had the shots done?
 
I called my doctor. He understand the situation.

He told me to call insurance and get preauthorization with the following code to see if it's approve. If it does, then I should be ok. If not, he wont make me pay.

I guess everything is ok

Not fishy at all. The doctor shells out a lot of money for the vials of allergen, so they must cover themselves legally to keep from losing money.

If you haven't taken any shots it sounds like you might actually be able to get out of it. It depends of if they've done anything on your behalf yet. I assume that they need a contract because something gets ordered or prepared especially for you.

Call them ASAP, tell them that your insurance won't cover it and that you can't take the shot. If they don't agree over the phone and try to fight you on it, send them a certified letter immediately, restating that you will not be able to take the shots, and per your conversation on May 7th, would like to cancel. Then, if they ever do take you to court, you at least have a fighting chance.

Your best solutions are diplomatic ones, though. Apologize profusely, tell them you can't afford it without insurance, and be as pleasant as possible. Don't bring up court or lawyers at all. Also, read every line of the contract to make sure there isn't some provision that gets you off, like a cancel period.
 
Those allergy shots are causing insomnia, stomach aches, and chronic fatigue.

Seriously, just ask your MD what are the options. I'm sure he would rather charge less than send your bill to collectors.
