Can you work 40 hours a week and be part-time?

She: My life will be a lot easier when I get back in January, because my boss promised to hire another part-time employee while I'm gone on winter break
so I'll be working like 20 hours a week instead of forty
Me: are you working 40 hours and classified as part-time?
She: Yep.
Good times, OWAIT
Me: how is that legal?
She: Well, it's what I was doing all summer because living expenses, and then I had trouble finding people to pick up my shifts when classes started.

So yeah, is it legal to work 40/week and be part-time? This is in IL.

If you are paid by the hour it could be called "part time" because you aren't on salary.

I think she can still be considered part time because she is not always scheduled full-time hours. It sounds like her 40 hour weeks are a temporary arrangement based on a shortage of personnel.

you'd be wrong. If she was working overtime then things are different.

Status isn't a labor law issue.

In IL you are part time if you work < 2000 hours a year.

WTF? Part time means you get stuck with whatever benefits plan they offer 'part timers' and that there's no guarantee of you getting the same number of hours. I've worked a dozen or two full time jobs and not been 'salaried'. The two have nothing to do with one another.
