or i could drive to the gas station in 5 minutes and call from the pay phone

Still the main thing you need to ensure is the dude doesn't get vindictive now he knows who you are and where you live. Chances are he will be back on the street fast if he was not armed and this was within his first half dozen B&E's.

Being you were home magnifies the crime a bit.

I'd find a way to really mess up his world though.
