Can you be busted for the act of downloading or only hosting?

Lets say you download copyrighted material and immediately remove it from the shared directory or block sharing altogether. Can you be caught (can they scan network traffic, or only browse lists of available files)?

They can bust you if you downloaded it from a computer the feds setup for just such a sting.

It was my understanding that they would have to prove that you do not own a copy of whatever it was you downloaded, which is why only the hosters are being sued.

why is everyone so afraid to talk about this stuff? my friends and i were sitting around talking about all the lawsuites and debating how the RIAA catches people. i think the whole thing is really interesting--the entertainment industry is trying to catch up with a technology that passed them by.

we werent debating that.
this is the type of knee jerk reaction that i am talking about. people automatically assume that i am attempting to defend the pirating of music and movies. this is a thread about technology and i would like to keep it that way. anyone who would like to add to the topic that respect would be greatly appreciated.

I'm sure laws can be manipulated so that law enforcement can do whatever the hell they please.

About the "kneejerk" reaction, well, people are paranoid; if i'm cheating on my GF with her sister, I probably would never bring the topic up anywhere, to keep people who wouldn't be so happy with my actions from finding out :)
