A few days ago, I made a cash deposit to my checking account. The deposit registered and then was "taken out" according to customer service. Nobody at customer service can tell me anything about why and branch employees tell me to call customer service. Can they just take money like that? Does anybody know how I get my money back?

Also: Does anybody know a good bank for a small business checking account? I'll need a checkcard without fees for the first 100 (or so) transactions and a low/no monthly fee.

BTW: The bank is First Union.

WHo took it out? For what reason? The bank can't just take your money for fun. There must be a reason.

If there is no good reason for them taking your money, then call your state attourny general, and contact your state bank regulatory unit.

I have Summit Bank and it's a no-fee check card. Unfortunately, I think Summit was acquired by Fleet (or some other mega bank) and everything may change.

Walk in at the same bank where you made your cash deposit, don't leave until you have your money back in your account or a reasonable explanation for its absence.

No bank can just take money like that...keep calling and complaining all the while make copies of all your deposits...and contact your state attorney general with the evidence.

Also a good bank is Washington Mutual.

Bank of America (formerly NationsBank) has always treated me right. I did a $400 deposit at an ATM, $400 that I really needed at the time. The ATM ate my check but didn't put the funds in my account. Didn't even give me a receipt. I walked into the bank and complained (it did help that there was another guy in there complaining about the same thing). They had me fill out a form and I had the money in about 3 business days. Luckily, none of the checks that I had written cleared in that time so I didn't have to bother with bounced check fees.

As far as a small business account and no fees.. thats not Bank of America. I think we have like a $1000 minimum balance or it's $11/month, IIRC. Been a while since I checked into it, I let my roommate handle all the money.

If you have a deposit receipt then you have everything you need to get this fixed. Demand to speak to the branch manager. Banks are subject to very strict auditing both from internal and Federal Reserve auditors. The teller that took your cash deposit had to have an offset for it when his work(deposits, cashed checks etc) was batched and sent to the proof department. Not only must the teller's cash drawer balance to the penny but the branch has to balance to the penny etc. Be polite but firm with them and you should be able to get some answers.
