Can people legally sell their iPod's on ebay loaded w/ music?

If they in fact deleted all the music off their pc? (and i suppose destroyed any and all cd's they ripped onto it)

Just curious because i've been noticing quite a few "loaded" iPods for sale on eBay....
 
No, legally you'd have to include the original source for the music (CDs, cassette, whatever), but then again how could you fit the internet on an iPod?
 
i dont think its legal if you claim its loaded, but nobody can check. RIAA would be hard pressed to prosecute anyone doing this.

its like if you sell a DVD player or a DVD library-player and happen to left your bootleg DVD in there, would you be arrested? i think not, as long as I dont advertised the fact that I 'accidentally' left them in there
 
It might be legal if they actually included the original CDs (and transferred their iTMS account if any purchased tracks).

But of course 99% of the tracks are P2P to begin with, or shared across multiple iPod sales.
