can i use the heat sink?

i was starting to build my gf's computer and then I noticed that the heat sink in the SFF has a broken lever

I would bug newegg for a replacement, but time is a factor (if it comes to it, i may spend money on another heat sink/fan). You think I can get way with this broken lever? There are 4 levers (one on each corner). It does not seem like the broken lever is doing much anyways, but it may different once i insert the CPU.

OK, I decided to buy another fan. I am gettign nowwhere with Newegg. I have not built a computer since 1999, so when i saw this socket and the lever at each corner, i was kind of confused. If I get a different fan with out those levers, how do I install it? I went to the store today and saw that lots of p4 motherboards had the same design as the mobo in my aopen ex661l. I also see that this lever design is not very common at all.
