California Supreme Court just owned Gray Davis's Un-recall effort

The state Supreme Court on Thursday declined to intervene in California's recall election, clearing the way for an Oct. 7 vote on whether to remove Gov. Gray Davis from office.

Something again tweaks my thinking..

If Davis abdicates and the Lt. Governor takes over the following occurs:

According to the Election Code the recall continues.
Cruz Bustamonte is the Governor.
Cruz Bustamonte has filed to be on the ballot and IS selectable as a candidate in the event the recall prevails.
Cruz Bustamonte would be subject to the recall of the Governor.
The Election Code indicates anyone subject to the recall cannot succeed him or her self.
Cruz Bustamonte would if the recall prevails and he is elected succeed himself.

OK California Supreme Court ... sort this out.

No, it has to happen enough times that CA voters get sick of it and remove that outrageous recall procedure that allows a minority, that could not win in a regular election, to harrass an elected governor anytime his approval dips below 50%.

No, it has to happen enough times that CA voters get sick of it and remove that outrageous recall procedure that allows a minority, that could not win in a regular election, to harrass an elected governor anytime his approval dips below 50%.

Davis hasn't been recalled by a minority of the voters. The only way he WILL be recalled is if a MAJORITY of the voters choose to recall him. The whole argument about a "minority of voters" is bunk - he hasn't been removed....yet. If a MAJORITY of voters wish to keep him then he keeps his job

BarneyFife - very true. It has become a joke because we have career politicians who do and say anything to keep their jobs. Most if not all career politicians are out of touch with real people.

That and people need to change california election law so the minority cant do this. But while we are talking about the minority partys, I wonder how supertool feels about senate filibusters and Texas redistricting. Both of these are being halted by the minority party. Should the rights of the minority party be protected or not?

California needs a real leader back in the Govenors office, not some slick willy politician. Now understand that I'm on the outside looking in but all I've seen coming from California for the last few years is circus circus circus - why add more?

The Florida Supreme Court was fulfilling it's responsibility as directed by Florida's constitution and the power given to them by the Florida legislature.

The US Supreme court on the other hand decided it didn't like what the US Constitution said about it being up to the States to run their elections with the House of Representatives deciding any controversies and picked Bush to be prez.

Seriously Moonie, to use a word of yours, you can't be a "sheep" and truly believe that this is a Republican problem. This is a political problem. Issues don't matter. Doing what is best for the country doesn't matter. Positioning yourself so that you can soak up as many votes as possible matters. Democrats, Republicans, they are all the same. They want power, and they'll do anything to get it. That's one of the main reasons I plan on voting for a 3rd party candidate- at least you know they aren't in it just for the hope of grabbing power, because they have no chance.

Both parties do have good sides to them though. But unfortunately, " Both " parties go to the extreme to push their " bad " sides to the very front. Therefore the U.S. people don't get to have as much problem solving done on their behalf as needed.

This is just plain Bull. The Republican idealogy favors exactly what moonie talked about... They favor compitition, merit, and individualism.. These traits require someone who is 100 percent self-interested to be "succesful", creates winners and loosers, are not condusive to a heathly family or coorperative enviroment. Liberals OTOH generally like inclusion and equality this favors a more inclusive and eqalitarion society but upsets the selfish 'overacheirs'..

For Federal Law... the Florida Supreme Court is the final arbiter for Florida State Law.

well, to be fair, Zebo, the republicans are at *least* as bad for Capitalism as the Socialist democrats, because they pay lip service to the creed and then betray it when it suits them. At this stage of the game, The Reps and Dems are two sides of the SAME coin. Most of the third parties, however, are a bit of a joke. There are a few in every camp who are genuine, honest, decent men and women who want to do the best for their country, but for the most part, the Politicians are the problem. They ignore the public when they shouldn't, and they pay attention to the public when they should ignore them. It's very often "all about the votes."

PS: Ray, actually the Supreme Court of the United States is the Final Arbiter for ALL laws. Even state laws can be overridden by the Federal Supreme Court. If that were not so, Chinese people wouldn't be allowed to own property in California (by the California Constitution, 1879 if I recall the year correctly!)

USSC cannot "opine" on that which is reserved to the states. Only federal issues are litigated in Federal Courts or issues between the states and then using state law in federal court. When the 11th heard and passed off the Bush v Gore case it was on the Federal Issue of the 14th amendment.

edit.. maybe you mean that someone can claim something violates the US Constitution and plea for a Cert before the USSC. If it gets past the dist court and fed appeals it prob. does and so I'd agree the USSC has the final say on what the Constitution says and if a state law or action violates its provisions but, state law is state controlled.
