Ah, so Gray Davis' sees a sinister nationwide Republican agenda behind the recall, BUT I bet he won't see a sinister nationwide agenda behind the Democratic move to subvert the will of the people in the courts.

Fine with me. I love that now the idiot liberals in this state will get to suffer for their stupidity a while longer.

Not only that, but after nominating a pathetic loser in the last election, the GOP has managed to have not one, but two pathetic losers running in this one, and can't decide which loser they like more. Didn't McClintock run for Lt. Gov in last election and got his @$$ handed to him by Bustamante?
What were these Scottish accent ads all about?
As far as will of the people, it was registered last year in the gubernatorial election, and now the GOP is the one trying to subvert it. They still haven't explained what it is Davis did that warrants a recall. All they are accusing him of is not being totally honest about the budget, but that wasn't under oath, and certainly it's the oppositions' job and not Davis' to bring up bad things.

Hmmmm, the recall drive started when? A week after the election? Couldn't be a bunch of sore-loser republicans trying to pervert the spirit of the recall laws. Nah. Perhaps next election, the repubs could run a candidate that has some chance of winning, unlike the growing roster of complete tools we've seen lately.

Yes, this will certainly be appealed. I'm curious about the general feeling of having courts interfere in elections. Personally, I'm against it for the most part. It's possible that there might be some circumstances under which I'd be in favor of it but the 2000 Presidential election and the Davis recall aren't examples of that.

Here is the old 'equal' clause again, I'll bet. I wish the court would forget about trying to make everything equal. It was equal when Davis was elected. What happened to make it unequal? Issa and his crew used the law to bring about the recall so lets vote! If need be have someone at the polls to insure the folks know how to use the punch card system... but, lets vote...

So what will this make it, 29 out of the last 31 decisions overturned? This appeals court needs to be smacked severly upside the head.

The Floriduh situation is different - it was a State Supreme Court rewriting Election law on the fly. This "decision" by the 9th circus court is not quite to that level, but rivals it on the stupidity scale.

Well, you have to realize that the 9th U.S. Circuit Court of Appeals only delays the recall vote, not removes it. In the rush to republicanize CA, you don't want another repeat of the Flordia fiasco do you? Or, considering how well FL2K3 worked out, maybe you DO? Why don't we just go a step further and have the USSC appoint our governor for us? Clearly, that seems to be in the best interest of CA.

Why because the Supreme Court will force them to hold an election IAW it's own state laws like they did in Florida? Reminding them that they can't change the laws after the fact. The CA constitution says to hold the election within 60 days and that is what should happen. People who aren't smart enough to fill out a ballot have no business voting anyway.

I personally think this whole recall thing is a joke. Maybe the next big "movement" in CA should be to have the recall part of their constitution re-written so you're not electing a govenor on a quarterly basis.

If the argument is that they are not opening ALL of the polling stations, they I concur with the decision...but no idea on what grounds they granted the stay...anyone?

Actually CAD, I thought the Florida Supreme court did a good job of not rewriting election law. The 11th took the case on the "equal protection clause" as I remember from the 4000 times I linked it to you :) But, as daffy as I am from time to time maybe it was something else too..;)

I don't think this will be overturned flat out. I think it will be sent back with instructions to comply in some fashion. The election was to be held 60 days hence... so, once they comply with what ever they can comply with the election should be held with in 30 days of new sample ballot issue.

I am against the recall effort and the recall in general. As you know.:) But, this is like saying all Safeway makets and all Von's markets must have all their food within reach of the shortes common denominator or the folks will starve.. well... a stretch.. but.. anyway.

The GOP would be lucky to get the vote delayed to March. Right now, Arnold and McClintock will split the vote, giving the governorship to Bustamante.
Not that CA GOP knows what's good for them. ;)

Actually Luny - the Floriduh situation WAS as I stated - if your buddy Moonbeam ever grew a set and started a thread about it, instead of just whining about it in almost every thread(been better lately), I and others would be happy to show you just exactly what went on in regards to the FSC and USSC.;)

The 9th circus has laid waste to the constitutional right of Californians to have an recall election as their law states. You can't just change the rules once the process has begun...welll you could...if it was the LEGISLATURE who was doing it instead of a court. The 9th circus doesn't have to power to "reschedule" a recall vote - period.
