I did a search, could not find the old thread, for some reason.....

So apparently this is such a regular problem they actually had to pass a law. Which is kind of sad. Our society is clearly being overrun with miserable assholes.

While I appreciate the intent of this law it seems almost impossible to enforce.

The larger issue IMO is that the practice of forcing a pregnancy without the partner's consent is actually a pretty big social problem. And in fairness, not unique to any gender.

Right and then you say 'no, I didn't' or 'she said it was ok not to use one' and then the cops realize it's impossible to charge anyone.
Hmmm... Is it a crime or a civil penalty? Different standards. I think it's civil per the story where the standard is just more likely than not.

If she calls to the stand her friends and exes who all say she always requests a condom, and your exes all say you never use a condom I think it's pretty clear which side is more believable in a civil case. I mean if you're the kind of guy who does that sort of thing, you probably aren't too smart and aren't trying to hide it.

I think the biggest issue is cases where the condom breaks but you don't realize it till it's too late.

Yeah no offense but you're just wrong.
In California they actually believe women. And they charge men who rape them. And now they will charge men who "stealth" them.
Cali might be the most fucked up state in the Union, but they they at least prosecute men. Well, assuming they arent rich and famous like Weinstein.

I guess we'll see. As mentioned above this appears not to be a criminal law and instead gives women a civil cause of action against men who do this, which certainly makes it more likely they can prevail sometimes. In terms of criminal charges if they ever make that law though I hate to break it to you but that's not going to work.

First, rape is actually very rarely successfully prosecuted. Different sources come up with pretty different numbers but the consensus appears to be <5%. Second, rape is a lot easier to detect and prove than this would be! You're probably talking well below 1% of offenses successfully prosecuted here.

Sex was a hell of a lot easier when I was a young fellow.

Actually I think with internet dating today and the prominence of the escort market and only fans/pornhub it's probably easier today for young people to be having sex. I mean back in my day if you wanted to get laid you needed to go to a bar and hustle up some action or be in a long term relationship. Now you just go to any number of dating sites, escort sites, only fans sites and you can be setup at the click of a button. I mean with escort markets in most major cities I have no idea why young guys would be dating at all: you pay about the same amount of money and get guaranteed results and still have the option of dating whoever you want.

Where I'm from having sex with a woman *in any way against her given consent* is called rape.

So the same deal as with most rapes right? So going by that rationale either existing rape laws are pointless or… its just hard to prove. You’ll still get a dot in your papers… and if those dots pile up, well, something.

Why would someone want to slip off a condom? So you're wearing protection to avoid pregnancy but you really want someone to get pregnant because you look forward to the costs associated with having kids.

I would suspect that in the vast majority of cases the person doing it is not thinking that far ahead.

Yeah I still havent figured that one out. Which is why I was curious as to how this got to be such a major problem it needs a new law.

When guys are horny they make bad decisions. I think a lot of those guys think they will pull out in time so get the win win of condomless sex without the risk of pregnancy. But we all know what happens when guys try that method. Also there's the STD issue as well.

I mean guys are just dumb when horny, myself included. Testosterone is a hell of a hormone.

Yeah so its guilty until proven innocent? FFS do we need to video tape every sexual encounter?

I cant possibly be the only one here with a problem with condoms... Can I make them work? Sure, yea.. Is it an amputated experience? Yes it is. Something that is "supposed to be" seamless is suddenly a core mechanic, its.. meh.
