California, 30 over speed limit is reckless driving?

Hey.

My idiot girlfriend's brother got pulled over for 92 in a 65 zone. Thats 27 over, so I'm wondering if thats over enough for reckless driving? I forgot whether it was 25 or 30 over to be considered criminal speed or reckless driving. I feel sorry for him, but I guess he got what he deserved.

Any info would be nice.

EDIT UPDATE: Since my question is answered, here's another question in the thread by Importedthat deserves answering.

I believe it's up to the officer to consider what is reckless driving..

I have a question tho (applies to CA, probably other states).

I got a 93 in a 70 last month, and my court date is on the 29th. As of today, I've yet to recieve any type of notice nor am I able to call into the court and pay my fine over the phone (the courthouse is 200-300 miles away) since they don't have my ticket on record yet.. What happens if the court date goes by and I've yet to recieve anything?

in VA, 15 or 20 over is reckless.. cant remember which.


but yeah, i'm guessing that even in Cali-- 27 over ought to at least be something

i thought it was 20. but if he didn't get "reckless driving" on the spot, I don't think he'll get one later.

Yea, thats a lot over. I feel like helpin him, but then I also feel like he got what he deserved. So, I'm helping him a little. :D

Yeah, i'm pretty sure it's 20. And there can be a big penalty for reckless driving.

My friend here in CA got pulled over for reckless driving and I think she had her license taken away from some amount of time

You can speed in california? I thought everything there was just one constant state of traffic jam :p

I don't know what the limit is for a reckless driving charge is here; I wonder if there even is one. I've heard of plenty of people getting tickets for going way over the limit, but the ticket was all they got. No criminal charges.

Yea, I told his ass to go get the ticket and see what it said. The guy got lost from Downtown sacramento to the Roseville area (north of downtown). Called me in the middle of the night and I talked him back on the freeway. Told him to take the 5 north, and switch to 80 east. Guy missed the exit and ended up hitting the 113 from the 5. Called me again and I told him to take 113 south and take 80 east. Called again later and was somehow still on 5 north. Had him exit and go on 5 south and he ended up on some back road or something. This time I stayed on the phone with him until he got back on 5 south and hit the 80 east... People in Sac know what I'm talking about. He said he was a little anxious to get home so I guess I understand. I was gonna make fun of his loser driving skills next time I see him, but maybe no considering his bill.

EDIT: He says it only says speeding but on top there are three things, misdemeanor, traffic, and non traffic. The traffic box was checked. Whats that mean? Also, considering how you usually go to court to fight a speeding ticket, do you think he'll get hit with reckless driving if he goes to court?

98 in a 70 is in kansas.

EDIT: at least that's what the cop said. maybe he just wanted me to think he was nice when he let me off with a $220 ticket.

no big deal, it'll prob be a ~150 dollar ticket. I had a 90/65 ticket and it was about 150 dollars.

Cool, thanks OS. Although I'm hoping the extra 2mph isn't gonna effect it much. Should I still recommend he fight it in court? How come you're not on aim, OS?

EDIT: I've never got a speeding ticket myself. Does the DMV send you a bill later on, or how does it work? He says it doesn't say the fine on there.

um...yeah, reckless driving can be very serious. It's not just a ticket. They can suspend your license and I believe it goes on your record as a felony or misdemeanor...something serious. But whatever it is, it's certainly not just a ticket

i think it was 25 over here in los angeles... but the judge seems to take it case by case... after he looks at your driving record... if it is reckless driving that's 2 points

2 mph won't do much. My friend got caught doing 110 in a 65 and they just gave him a 2 point ticket. Sucky but hardly the end of driving. No reckless driving charges. Reckless driving is at officer discretion and it'd say on the ticket if that was coming into play.

He can fight it if he has the time. Just call the court and keep asking for extensions until you run out, before and after you set a trial date. For the 3 times I've tried that method, twice the officer didn't show. If the officer does show, ask to have your plea reversed and take traffic school. Unless you have an airtight case, you'll probably lose the trial.

DMV will send you a notice saying how much the ticket will cost. The citation itself won't have any fine information on it, it's not supposed to.

I had 24 over in CA, and no traffic school for me. I bet he just has to pay and suck up the point.

Well - if you're going to get the point regardless - you might as well try to fight it. I'm not sure about the exact speeds but I do know that you HAVE to show up to court if you go over 100mph.

pretty sure it's different in each state... in IL i know for a fact it's 20mph over limit or more... it would depend on the cop and the weather conditions too....

BTW when i went to get court supervision for my ticket.. 72 in a 55... there was a girl there that was told by the judge if she faced reckless driving charges she could face up to 364 days in jail and a heavy fine.. i think it was 5-10k but then the judge said that he would drop that charge and just have her pay the ticket

Hmm... Iono. I'll edit your question into my original post so it'll get answered. As for help for me, he's being kind of a dumbass, so no more help for him. Too bad, I work at a lawyers office too, so I coulda gotten him a lot more help tomorrow when I went into work.

I wanted to keep the convo on aim and told him so. Gave him my reasons but he insisted on calling my cell like 5 times and calling my apartment enough to aggrevate my roomies. Kids gotta learn that when he's the one that needs something, he's gotta do it by the helper's rules.
