Yes, It's illegal. The hardest part isn't doing it, it's doing it w/o your ISP knowing. What's your DL/UL? www.dslreports.com can help you with tweaks etc. if you want. Just don't ask this question on their BB.

I get 2mbs download that is not the problem
I want to get rid of the 384k/s cap on the upload more than anything
how is roadrunner/ time warner? can they find out easily?

The more you pay, the faster it gets. If your capped, there's nothing you can do about it. Do you mean 340KBS or Kbs? Cables UL isn't going to compare to it's DL

That sounds about normal for Cable. And when you are talking about DL, are you talking about Internet speed tests, or real life DLing? There's a big dif there also. Not sure the specifics as to why UL is so slow with Cable. You're getting normal UL speed tho.

illegal? hehehe no, it's not illegal. I work do @Home cable tech support. It's not illegal, but with the @Home service, techs are the only ones who can change your account (and the cap) and we can get fired for it.

It's NOT illegal. It's just dangerous. :)
