If you and lets say a friend is on the same cable provider.

Is it possible to have the two computers on the network ? meaning share files between his computer and my computer ?
 
Yes, but you need to do it in some secure manner (NOT Windowz file sharing) because it will be open to the rest of the world as well.

its actually easier to just set up and FTP on them and log into each other. or use AIM Get File Method

But if it was on the network would it be beyond the maximum upload bandwidth cap ?

mine is currently at 384k.

Than that is as fast as you will be able to transfer to him.

There's a way but can get you in trouble w/the cable company. There are websites that describe ways to hack the cable modem and bypass the cap. Never tried it, myself.

What would happen if you have your own modem that's already uncapped ?
