Buying 3G iPhone

I went into an AT&T store the other day and asked if I would need to be eligible for an upgrade to buy an iphone. They said that I did not and that it doesnt matter how long into a contract you are, you can go and get the new iphone for $199 and just renew your contract from that date. I also read a few comments on the AT&T support forums from admins saying the same thing, Im looking for those comments now.

As of a few days ago I was eligible for an upgrade but, being under the impression that I did not need my upgrade to buy an iphone, I used that upgrade to order a Blackberry Curve online for my brother.

Now tonight I came across this page on AT&T's website saying that in order to get the iphone I need to have an upgrade to get the phone for $199.

So which is it, do I have to be eligible for an upgrade or can I walk into an Apple store when ever I want and get the phone for $199 no matter where I am in my contract?

You do not need to be eligible. They'll sell you one for $399 if you're not.

but its 199/299 if you're a generation 1 iphone user... i upgrade mine to the 16gb for 299 and gave my gen 1 to my sister..

EDIT: and my old gen 1 is jail broken and she uses it on tmobile..
