Is it bad to purchase OEM microsoft software on ebay. It complies with OEM agreements? What are the downsides?

As long as they include a peice of hardware to make the OEM sale legit, I don't think there's an issue at all.

I wrote to one of the guys selling some software, and this is what he said.

The CD key is used, so you may be unable to register the product. But the software is new (i.e. the CD it comes on is new).

Sounds like piracy. Be careful.

A lot of those sellers are kinda sketchy if you ask me. I have a friend who bought a Windows Server 2000 license and the COA wasn't what you'd call a normal COA... Though he insisted it was. I was very skeptical, and tried to argue with the guy on behalf of my coworker. I could never get a straight answer as to why the COA looked different than for say a normal XP sticker COA...

So anyway, I personally wouldn't trust those sellers. If you absolutely positively need legit licensed software, then buy retail and save the headache.

I would definatly not trust sellers on eBay for MS software - too much chance of getting a pirated copy. This goes double if the seller is overseas.

Of course, if it's a guy in the US, you could always take the chance, then if it's a pirate copy turn the guy into MS and get a free copy of XP as your "bounty".
